This Niagara Escarpment Plan amendment proposed to establish a six-unit plan of condominium partially located on the prominent slope of the Niagara Escarpment. The subject lands consisted of a 2.78 hectare (6.9 acre) portion of a 94 hectare (233 acre) existing lot containing the Osler Brook Golf and Country Club.
New residential development is not permitted on prominent Escarpment slopes within the Escarpment Recreation Area land use designation; only ski-related recreational development is permitted on prominent Escarpment slopes. To allow an exception to this policy, an amendment to the Niagara Escarpment Plan is required.
Effects of consultation
The consultation with agencies and local residents resulted in objections from five members of the public, as well as concerns expressed by the local municipality and conservation authority.
Based on these comments and the information provided by the applicant, the Niagara Escarpment Commission staff recommended that the Commission not support the amendment. However, the Commission did not take a position on the amendment; the Commission deferred a decision to allow the proponent additional time to resolve outstanding concerns.

This notice was updated on June 12, 2019 to advise the public that there has been no change to the status of the proposal and it is still being considered. No additional opportunity for comment is bring provided for at this time.
Description of policy
A Niagara Escarpment Plan Amendment is required to allow the creation of a new lot, the establishment of common lands, a condominium roadway, one condominium unit/lot and part of a second, to locate partially on the prominent Escarpment slope as an exception to Development Objective 1 of the Escarpment Recreation Area designation of the Niagara Escarpment Plan (NEP).
The subject lands are a 2.78 hectare (6.9 acre) portion of a 94 hectare (233 ac) existing lot containing the Osler Brook Golf and Country Club.
The remainder of the condo plan (Units 2, 3, 4) is not located on the prominent Escarpment slope and therefore does not form part of the proposed Amendment.
A NEP Amendment is required for the portion of the proposed development located on the prominent Escarpment slope because the Escarpment Recreation Area designation permits only ski-related recreational facilities, such as ski trails, which require the slope to function,. A road and new residential lots are not permitted recreational uses since they do not require the slope and can locate elsewhere. An exception to the NEP, in the form of an Amendment, is required to permit this development.
Purpose of policy
To amend the Niagara Escarpment Plan to permit a plan of condominium on the prominent Escarpment slope, as an exception to Development Objective 1 of the Escarpment Recreation Area.
Other public consultation opportunities
On August 24, 2012 the Niagara Escarpment Commission (NEC) circulated the proposed amendment and supporting materials to municipalities, ministries, interested/affected agencies, stakeholders and property owners and other parties that have shown an interest in the amendment.
Notice of the amendment and the request for comments was placed in the local newspaper (Collingwood Enterprise Bulletin) on August 24, 2012.
Also on August 24, 2012 the Amendment document was posted on the NEC website and comments were invited during the ensuing 60 day comment period.
The Niagara Escarpment Planning and Development Act (NEPDA) requires that a Public Interest Advisory Committee (already established as a permanent advisory committee under the NEPDA by the Minister) meet to provide advice on the proposed amendment to the NEC. This meeting will take place after the comment period has ended.
