Decision summary

The government has released A Place to Grow which replaces the Growth Plan for the Greater Golden Horseshoe, 2017. Housekeeping changes to O.Reg. 311/06 clarify how to apply the Plan’s policies, update Plan references, provide clarity for decisions on certain matters before the Local Planning Appeal Tribunal and rules that are no longer needed.

The following modifications to O. Reg. 311/06 under the Places to Grow Act, 2005 will come into force on May 16, 2019:

Ontario Regulation 85/19 Amending O. Reg 311/06

Ontario Regulation 311/06, as modified, sets out specific rules for planning matters in process at the time the Plan comes into effect on May 16, 2019.

Ontario Regulation 311/06 was amended to provide clarity on how to apply the Plan’s policies to planning matters by:

  • Changing references to “the Growth Plan for the Greater Golden Horseshoe, 2017” to “the Growth Plan for the Greater Golden Horseshoe 2019”;
  • Deleting provisions that had been added to the regulation on June 28, 2017 to support implementation of a phased-in designated greenfield area density target;
  • Deleting the provisions that had been added to the regulation on May 4, 2018 to address how the designated greenfield area density target apply to certain settlement areas (now rural settlements); and
  • Providing that where the Local Planning Appeal Tribunal has completed a hearing but not yet issued a decision, those decisions are required to conform to the Growth Plan for the Greater Golden Horseshoe, 2017.

Effects of consultation

In addition to the 650 submissions received, the Ministry held seven regional roundtables and a stakeholder exchange with representatives of municipal planning and economic development departments, developers/homebuilders, agricultural and environmental representatives, citizen groups and other stakeholders. Over 400 people participated in these sessions and a dozen additional technical discussions with a cross-section of stakeholder organizations were conducted.

The Ministry also held meetings with several First Nations and Métis communities and organizations.

In finalizing the proposed modifications to the regulation, all comments received were carefully considered. There was one modification made to the regulation to provide that the Growth Plan, 2017 applies to matters before the Local Planning Appeal Tribunal where a hearing has been completed but a decision had not been issued when A Place to Grow comes into effect.

The modifications to the regulation that took effect on May 16, 2019 provide for greater certainty in the land use planning system and implement legislative direction set out in the Planning Act.

In response to consultation, there were requests for the transition of specific planning matters. A notice has been posted concerning proposed further amendments to Ontario Regulation 311/06 to provide transitional treatment for certain planning matters.

This proposal works with the following other proposals that are also currently listed on the Environmental Registry of Ontario and Ontario’s Regulatory Registry:

  1. Proposed Amendment 1 to the Growth Plan for the Greater Golden Horseshoe, 2017.
  2. Proposed Modifications to O. Reg. (Exemption from Approval – Official Plan Amendments) made under the Planning Act to implement the Proposed Amendment to the Growth Plan for the Greater Golden Horseshoe, 2017
  3. Proposed Framework for Provincially Significant Employment Zones

This proposal is for Proposed Amendment 1 to the Growth Plan for the Greater Golden Horseshoe, 2017 for the Greater Golden Horseshoe, 2017. It is recommended that Proposed Amendment 1 be read in conjunction with the Growth Plan for the Greater Golden Horseshoe, 2017, as it sets out proposed modifications and makes reference to definitions and policies included in the Growth Plan. To assist in reading these documents together, the Ministry has prepared the Draft Amended Growth Plan which is meant to show how the Growth Plan for the Greater Golden Horseshoe, 2017 would read if Proposed Amendment 1 to the Growth Plan for the Greater Golden Horseshoe, 2017 is approved.

O. Reg. 311/06 is a Minister’s regulation under the Places to Grow Act, 2005 that prescribes transition provisions for growth plans under that Act. This regulation only applies to the growth plans under the Places to Grow Act, 2005 such as the Growth Plan for the Greater Golden Horseshoe. The provisions in this regulation are distinct from the transition provisions that apply to the Greenbelt Plan and the Oak Ridges Moraine Conservation Plan, as provided for by the separate legislation governing those Plans.

This regulation was last modified on May 4, 2018 to support implementation of a standard method to calculate the amount of land needed for development to the horizon of the Growth Plan for the Greater Golden Horseshoe, 2017, known as a land needs assessment. Other than the modifications proposed in this notice, no further modifications to this regulation are being considered at this time.

Purpose of regulation

It is proposed that the Minister would make the following modifications to the Growth Plan transition regulation to align with Amendment 1 to the Growth Plan, 2017, if approved:

  • Change references to “the Growth Plan for the Greater Golden Horseshoe, 2017” to “the Growth Plan for the Greater Golden Horseshoe, 2017 as amended by Amendment 1”;
  • Delete provisions that had been added to the regulation on June 28, 2017 to support implementation of a phased-in designated greenfield area density target; and
  • Delete the provisions that had been added to the regulation on May 4, 2018 to support implementation of a standard method to calculate the amount of land needed for development to the horizon of the Growth Plan, known as a land needs assessment.

In addition to the above proposed modifications, the Minister is seeking feedback as to whether there are any specific planning matters (or types of matters) in process that should be addressed through the transition regulation. This could include, for example, official plans or official plan amendments that have been adopted and are currently under appeal.

Prescribing such matters or types of matters in the regulation could allow them to be approved in conformity with an earlier version of the Growth Plan and/or provide for an exemption from some policies in the Growth Plan for the Greater Golden Horseshoe, 2017 as amended by Amendment 1, if approved.

However, other Provincial plans, including the Greenbelt Plan and the Oak Ridges Moraine Conservation Plan, would still apply in their areas. The Minister is not considering making any changes to the applicability of the policies in those Plans in connection with this proposal.
