Decision details
As part of an agreement with the province, Algoma Steel Inc., the new owners of the steel mill, is required to prepare and implement a plan to identify and address past environmental contamination at the Sault Ste. Marie mill site. The plan, which has been reviewed and approved by the ministry, is called the Legacy Environmental Action Plan.
This program approval was issued to Algoma Steel Inc. to formally authorize the requirement for the development, approval and implementation of the Legacy Environmental Action Plan. The program approval also allows for financial assurance provided to the ministry to be held for the purposes of carrying out some or all of the work described in this program approval.

Description of instrument
Ontario’s Environmental Protection Act (EPA), allows a person responsible for a source of contaminant to submit a program to prevent or to reduce and control the discharge into the natural environment of any contaminant from the source of contaminant. A Program Approval is a document describing the associated abatement activities, developed by the person responsible and approved in writing by the Director under the authority of sections 10 and 11 of the EPA.
On January 15, 2019, Algoma Steel Inc.. submitted a Program Approval request to the Ministry of the Environment, Conservation and Parks (“ministry”) for measures to prevent or to reduce and control the discharge of contaminants into the natural environment associated with historical operations on the Algoma Steel Inc. steel mill, landfill site and related properties located in Sault Ste. Marie.
This request is part of a Court approved asset purchase agreement in the insolvency of Essar Steel Algoma Inc. In consideration of this request, the ministry is proposing to issue a Program Approval to Algoma Steel Inc. under sections 10 and 132 of the EPA which includes the implementation of a ministry-approved Legacy Environmental Action Plan among other items.
The Program Approval also requires that the financial assurance provided to the ministry in accordance with an agreement entered into between the ministry and Algoma Steel Inc. as part of the insolvency proceedings of Essar Steel Algoma Inc. be held for the purposes of carrying out some or all of the work described in this program approval.
The issuance of this Program Approval in no way relieves Algoma Steel Inc. from complying with any applicable provincial regulatory requirements that are not addressed as part of this Program Approval.
The Director is considering the issuance of a Program Approval which is attached to this notice.
