Why consultation isn't required
On April 1, 2020, the Ontario Government made a temporary regulation to respond to the COVID-19 outbreak. Ontario Regulation 115/20 exempts all proposals for policies, acts, regulations and instruments from posting requirements under the EBR until 30 days after the declared emergency is terminated.
Although consultation was not required, the ministry did consult with the public on this proposal by posting EBR #019-1905 for public comment from June 8, 2020 - July 8, 2020. To ensure transparency, the ministry is providing details of its decision and the effects of consultation on decision-making in this notice.
Bulletin details
The existing dispenser is on a concrete slab and is not susceptible to flooding or ice movement. The dispenser is also well protected on two sides by concrete retaining walls.
Moreover, dispensing does not take place at this location: The dispenser is connected by aboveground steel pipe to hose reels. From the reels, marina staff pulls the hose to the floating dock to fuel the boats. The floating dock is approximately 7 metres from the building door; vapours are generated here, at the nozzle, much further than the 4.5 metres required by the Liquid Fuels Handling Code. Therefore it is unlikely that vapour will enter the building.
