Bulletin summary

Approval was granted for a site plan amendment to authorize McCann Redi-Mix Inc. to extract below the water table at the Burkhart Pit in the Municipality of Lambton Shores.

Why consultation isn't required

On April 1, 2020, the Ontario Government made a temporary regulation to respond to the COVID-19 outbreak. Ontario Regulation 115/20 exempts all proposals for policies, acts, regulations and instruments from posting requirements under the EBR until 30 days after the declared emergency is terminated.

Ontario Regulation 115/20 was revoked on June 15, 2020, however, we are posting this decision as a bulletin because the proposal was posted on April 3, 2020 while Ontario Regulation 115/20 was in effect.

Although consultation was not required, the ministry did consult with the public on this proposal by posting ERO 019-1478 for public comment from April 3 – May 4, 2020. To ensure transparency, the ministry is providing details of its decision and the effects of consultation on decision-making in this notice.

Site location of the instrument

Municipality of Lambton Shores, County of Lambton.

Part Lot 19, Lake Range East Concession, Geographic Township of Bosanquet.

The site is Aggregate Resources Act (ARA) Licence # 5395.

The site is approximately seven kilometres southwest of the Community of Grand Bend.

Instrument decision details

A change to ARA licence No. 5395 was approved by the Regional Director on March 31, 2022. 

The approval allows McCann Redi-Mix Inc. to amend the current site plan to change the final depth of extraction from above the water table to below the water table. The depth of extraction will change from 180 metres above sea level (m.a.s.l) to 169 m.a.s.l. The final rehabilitation of the site will change from a natural regeneration area in a dune environment to a 10.02 hectare pond with a proposed natural environment after use.

  • rehabilitation and post-operations land use considerations
  • habitat of endangered and threatened species
  • significant wildlife habitat concerns

The concerns were addressed by revisions to the final approved copy of the site plan and by providing additional information.
