Bulletin summary

On April 8, 2022, the Minister of Municipal Affairs and Housing filed a Zoning Order, made pursuant to clause 47(1)(a) of the Planning Act, with the Registrar of Regulations as Ontario Regulation 338/22 and Ontario Regulation 339/22. The Minister of Infrastructure requested that the Minister consider making the Zoning Orders.

Why consultation isn't required

Part II of the Environmental Bill of Rights Act, 1993 does not apply to proposals to make a Minister's Zoning Order (MZO) under subsection 47(1) of the Planning Act, or to amend or revoke an MZO under subsection 47(8) of the Planning Act.

Bulletin details

A Zoning Order, made pursuant to clause 47(1)(a) of the Planning Act, regulates the use of land and the erection, location and use of any building or structure on the land.

O. Reg.(Ontario Regulation) 338/22 and 339/22 provides permissions for a range and mix of residential, commercial and institutional uses to support the development of a Transit-Oriented Community. Specifically, O. Reg. 338/22 provides for a maximum total gross floor area of 35,970 square metres. O. Reg. 339/22 provides for a maximum total gross floor area of 39,230 square metres.

O. Reg. (Ontario Regulation) 338/22 applies to lands municipally known as 1 Atlantic Avenue in the City of Toronto.

O. Reg. (Ontario Regulation) 339/22 applies to lands municipally known as 1 Jefferson Avenue and 2 - 20 Atlantic Avenue in the City of Toronto.

Pursuant to subject 47(4) of the Planning Act, and except for the purposes of section 24, the Minister deemed O. Reg. (Ontario Regulation) 338/22 and O. Reg. (Ontario Regulation) 339/22 to be and to always have been by-laws passed by the Council of the City of Toronto.
