Why consultation isn't required
Part II of the Environmental Bill of Rights Act, 1993 does not apply to proposals to make a Minister's Zoning Order (MZO) under subsection 47(1) of the Planning Act, or to amend or revoke an MZO under subsection 47(8) of the Planning Act.
Bulletin details
A Zoning Order Amendment, made pursuant to clause 47(8) of the Planning Act, regulates the use of the land and the erection, location and use of any building or structure on the land.
The amendment to O. Reg. 438/20, filed as O. Reg. 455/22, permits additional uses, including a community centre, day care facility, research and training facility and a medical clinic on the subject lands. A 0.5-hectare addition to the geographic area of the Minister’s Zoning Order (MZO) is also included in the amendment.
O. Reg. 438/20, as amended, permits the development of a 192-bed long term care facility and 320-unit retirement home on the lands known municipally as 1401 Harwood Avenue North, Town of Ajax.
