Why consultation isn't required
Part II of the Environmental Bill of Rights Act, 1993 does not apply to proposals to make a Minister's Zoning Order (MZO) under subsection 47(1) of the Planning Act, or to amend or revoke an MZO under subsection 47(8) of the Planning Act.

O. Reg. 40/23 applies to approximately 300 hectares of land between Rose Point Road and Oastler Park Drive in the Township of Seguin.
A Zoning Order regulates the use of land and the erection, location and use of any buildings or structures on the land. O. Reg. 40/23 accelerates the development of a new mixed-use community in the Township of Seguin.
Pursuant to subsection 47(4) of the Planning Act, and except for purposes of section 24 of the Act, the Minister deemed O. Reg. 40/23 to be and to always have been a by-law passed by the Council of the Township of Seguin.
