This notice was originally posted as an information notice on the old registry by Ministry of Natural Resource and Forestry as 013-1890. The Ministry of Environment, Conservation and Parks is now updating it with an instrument decision notice.
On April 11, 2023, the Minister of the Environment, Conservation and Parks issued an overall benefit permit to CRH Canada Group Inc. under subsection 17(1) of the Endangered Species Act, 2007 (ESA) concerning the following species and their habitat:
The permit enables the applicant to expand the existing Acton Quarry, in the Town of Halton Hills, Ontario.
The permit authorizes CRH Canada Group Inc. to adversely impact:
- Jefferson Salamander and Unisexual Ambystoma (Jefferson Salamander dependent population) individuals
- up to 17.8 hectares of Jefferson Salamander and Unisexual Ambystoma (Jefferson Salamander dependent population) habitat
Protecting species under the Endangered Species Act
Our government is committed to protecting species at risk and providing strong environmental oversight, while working to support development opportunities in the province.
Businesses, municipalities and other proponents are expected to take steps to ensure their projects avoid any adverse impacts on species at risk or their habitats. However, where avoidance is not possible, the ESA gives the Minister the discretion to authorize activities if certain conditions can be met.
The permit includes conditions that requires CRH Canada Group Inc. to undertake measures that will:
minimize adverse effects to Jefferson Salamander and Unisexual Ambystoma (Jefferson Salamander dependent population)
- achieve overall benefits to Jefferson Salamander and Unisexual Ambystoma (Jefferson Salamander dependent population) within a reasonable timeframe
Actions to minimize adverse effects to species
The permit requires CRH Canada Group Inc. to carry out actions to minimize adverse effects on Jefferson Salamander and Unisexual Ambystoma (Jefferson Salamander dependent population), including:
- engaging qualified professionals to oversee that the proposed permit conditions and mitigation measures are properly implemented on the site
- providing species education and awareness training to all construction personnel working on site
- installing temporary exclusion fencing around the perimeter of the site to prevent Jefferson Salamander and Unisexual Ambystoma (Jefferson Salamander dependent population) from entering the site during their active season
- inspecting and repairing the exclusion fencing
- conducting a thorough targeted salvage operation before each active season
- searching the construction area to ensure that no individuals are present before work starts in an area
- ensuring that if any salamanders are encountered on the site during the project, work in the vicinity will stop until the individual is safely relocated by a qualified professional
- designing and constructing the water management system to avoid and minimize impacts
- implementing measures to maintain groundwater levels at the project site to mitigate impacts to breeding ponds
- installing erosion and sediment control measures and keeping them in good repair
Actions to achieve an overall benefit to species
The permit requires CRH Canada Group Inc. to carry out actions to achieve an overall benefit for both species within a reasonable timeframe. This includes:
- creating and actively managing 4.7 hectares of new forested habitat
- actively managing 7.2 hectares of young woodland, 10.9 hectares of thicket and 8.9 hectares of damaged mature woodland
These actions are expected to result in the following benefits for Jefferson Salamander and Unisexual Ambystoma (Jefferson Salamander dependent population) by:
- improving the quality of the forested habitat that surrounds the existing breeding pond
- increasing the amount and availability of high quality foraging, migration, dispersal and hibernation habitat
Other information
The following reasonable alternatives, including alternatives that would not adversely affect the species, were considered:
- not expanding the existing quarry
- proceeding with the full expansion as originally proposed
- reducing the originally proposed expansion area to decrease the amount of habitat impacts
The best alternative is to reduce the originally proposed expansion area, which meets the objective of the quarry expansion and supports aggregate needs through the licencing period. It also reduces the overall impact to habitat by more than half of the original proposal (46.5 ha down to 17.8 ha).
Ontario has published a government response statement (GRS) under section 12.1 of the ESA with respect to Jefferson Salamander and Unisexual Ambystoma (Jefferson Salamander dependent population). The permit reflects the following objectives outlined in the GRS for these species:
- maintaining and improving habitat quality
- protecting habitat
Effects of consultation
Three comments were received in response to the ERO posting:
- one comment was opposed to the proposal, asserting that the intent of the ESA was not being met
- the second comment requested that the new and enhanced forested habitat be reclassified to ensure its protection in perpetuity
- a third comment was not related to this proposal and had concerns with aggregate activities in another part of Ontario
Ministry response
Both comments related to this proposal were carefully considered.
The ESA enables proponents to seek a permit when they are not able to avoid adverse impacts to species at risk or their habitat. A permit may only be issued if the Minister believes that the criteria set out in the ESA have been met.
The approved permit:
- includes actions to minimize impacts to Jefferson Salamander and Unisexual Ambystoma (Jefferson Salamander dependent population)
- creates additional habitat for the species
Overall benefits to both species will be achieved within a reasonable time and will be accompanied by site monitoring. These actions support the protection and recovery of the species.
The ESA protects habitat regardless of its land use designation, and any activities that would contravene section 10 would require an authorization under the ESA.
No changes were made to the permit conditions as a result of these comments.

Description
Dufferin Aggregates has applied for a permit under clause 17(2)(c) of the Endangered Species Act, 2007 (ESA) to damage and destroy 21.8 hectares Jefferson Salamander habitat in order to undertake aggregate extraction within a licenced quarry under the Aggregate Resources Act in the Town of Halton Hills.
Purpose of the notice
The purpose of this notice is to ensure that the public is made aware of, and given an opportunity to comment on, the ESA permit application to damage and destroy Jefferson Salamander habitat associated with the extraction of aggregates from the Acton Quarry Extension Lands. The proposed permit would be issued under clause 17(2)(c) of the ESA.
Other information
The proposal has the potential to adversely affect Jefferson Salamander and its habitat. The proposed permit conditions would provide benefits that exceed the adverse effects on Jefferson Salamander.
Jefferson Salamander is listed on the Species at Risk in Ontario (SARO) List, in Ontario Regulation 230/08 of the ESA, as endangered.
Habitat protection under subsection 10(1) and species protection under subsection 9(1) of the ESA applies to Jefferson Salamander.
The Minister may issue a permit under clause 17(2)(c) of the ESA that authorizes a person to engage in an activity that would otherwise be prohibited by sections 9 or 10 of the ESA if the Minister is of the opinion that:
- an overall benefit to the species will be achieved within a reasonable time through the conditions of the permit;
- reasonable alternatives have been considered, including alternatives that would not negatively affect the species, and the best alternative has been adopted; and,
- reasonable steps to minimize negative effects on individual members of the species are required by conditions of the permit.
Providing an overall benefit to a protected species under the ESA involves undertaking actions to improve circumstances for the species in Ontario. Overall benefit is more than “no net loss” or an exchange of “like for like”. Overall benefit is grounded in the protection and recovery of the species at risk and must include more than mitigation measures or “replacing” what is lost.
The Proponent has explored reasonable alternatives to the proposed works, including alternatives that would not adversely affect the species or its habitat, including:
- Not proceeding with the proposed aggregate expansion project; or
- Reducing the area of originally proposed impact.
The current alternative, which has been proposed, includes altering original project design to reduce the area of regulated habitat impact from 46.6 hectares to 21.8 hectares.
The Proponent has sought out ways to minimize adverse effects on Jefferson Salamander and its habitat, such as:
- Installation of temporary exclusion fencing prior to the project commencing;
- Ensuring measures are implemented to rescue and relocate Jefferson Salamander should they be encountered during the project activities;
- Providing species at risk awareness bulletins provided to on-site personnel prior to commencing construction/servicing activities;
- Designing and constructing water management systems needed for the aggregate quarry in an a manner that will avoid or limit impacts to the Jefferson Salamanders;
- Implementing measures to maintain groundwater levels at the project site to negate impacts to Jefferson Salamander breeding pools.
- Timing activities to minimize adverse impacts on the species (e.g. avoiding the breeding season)
The Proponent has identified possible actions to achieve an overall benefit for Jefferson Salamander, such as:
- Creating approximately 12.5 ha of new woodlands adjacent to known Jefferson Salamander breeding ponds to create a suitable terrestrial habitat to facilitate dispersal, foraging and over-wintering of the Jefferson Salamanders;
- Undertaking active management of approximately 17 ha of existing forested habitat adjacent to known breeding ponds to control and reduce the spread of invasive species and promote natural succession of these lands to a mature, native forest which will provide dispersal, foraging and over-wintering of the Jefferson Salamanders.
Please note that the posting of this proposal on the Environmental Registry does not imply that a permit will be approved; a permit may only be issued where the legal requirements set out in clause 17(2)(c) of the ESA have been satisfied.
