Decision summary

On June 20, 2025, the Minister of Municipal Affairs and Housing filed a Minister's Zoning Order with the Registrar of Regulations as Ontario Regulation (O. Reg.) 125/25 in Prince Edward County. Prince Edward County requested that the Minister consider making the Zoning Order.

Decision details

A Zoning Order, made pursuant to clause 47(1)(a) of the Planning Act, regulates the use of the land and the erection, location and use of any building or structure on the land. The Minister's Zoning Order was made based on a request from Prince Edward County.

O. Reg. 125/25 facilitates mixed-use and residential development of 650-1,000 housing units including 120 purpose-built rental units.

O. Reg. 125/25 applies to approximately 88 hectares of land at 343 County Road 22 and 204 Kingsley Road in Prince Edward County (known locally as Base31). See Location Map below.

Pursuant to the subsection 47(4) of the Planning Act, and except for the purposes of section 24, the Minister deemed this zoning order to be a by-law passed by the council of Prince Edward County.

Effects of consultation

All comments received were taken into consideration prior to a decision being made.

These comments expressed concerns relating to following:

  • The capacity of the local transportation network;
  • The protection of forests and wetlands;
  • The compatibility between proposed building heights and existing development;
  • The environmental and financial planning for municipal services;
  • The potential for delays in build-out of the development;
  • That the number of affordable housing units will not be sufficient;
  • That the affordable units will not remain affordable over time;
  • That the market and tourism-based housing is not required locally;
  • That the background studies adequately support the development;
  • That sufficient information regarding the request was not provided to the public in a timely manner; and,
  • Opposition to the development of a historic military site, including opposition to the removal of the air strip and environmental contamination concerns.

Why consultation isn't required

Part II of the Environmental Bill of Rights Act, 1993 does not apply to proposals to make a Minister’s Zoning Order (MZO) under subsection 47(1) of the Planning Act, or to amend or revoke an MZO under subsection 47(8) of the Planning Act.

Although not required, the ministry is providing public notice of this request for consultation.

Proposal details

As part of the Cutting Red Tape to Build More Homes Act, 2024, the government is proposing to amend the Planning Act to remove the Minister’s authority to make Community Infrastructure and Housing Accelerator orders. However, a Minister’s Zoning Order, made pursuant to clause 47(1)(a) of the Planning Act, can still be used to regulate the use of the land and the erection, location and use of any building or structure on the land.

The Ministry has also introduced a zoning order framework that will help guide – in a transparent manner – how zoning order requests are considered in support of provincial priorities. Moving forward, municipal requests for zoning orders will be received and considered in accordance with the new zoning order framework.

The Ministry is in receipt of a request for a Community Infrastructure and Housing Accelerator order to facilitate mixed-use and residential development in Prince Edward County. This municipal request applies to 88 hectares on lands known locally as Base 31 in the community of Picton in Prince Edward County.

While no Community Infrastructure and Housing Accelerator orders will be made going forward, the Minister may instead consider making a Minister’s Zoning Order in response to this request, provided there is municipal support and other information outlined in the zoning order framework is provided.
