Decision summary
On August 2, the Minister of Municipal Affairs and Housing filed a Minister's Zoning Order, made pursuant to clause 47(1)(A) of the Planning Act, with the Registrar of Regulations as Ontario Regulation (O. Reg.) 324/24 in the City of St. Thomas. MEDJCT requested that the Minister consider making the Zoning Order.
Decision details
A Zoning Order, made pursuant to clause 47(1)(a) of the Planning Act, regulates the use of the land and the erection, location and use of any building or structure on the land. The Minister's Zoning Order was made based on a request from the Ministry of Economic Development, Job Creation and Trade (MEDJCT) to facilitate development of a gigafactory and industrial park on the subject lands.
O. Reg. 324/24 applies to approximately 617 hectares of land in the City of St. Thomas. See Location Map below.
Pursuant to the subsection 47(4) of the Planning Act, and except for the purposes of section 24, the Minister deemed O. Reg. 324/24 to be a by-law passed by the council of the City of St. Thomas
Effects of consultation
As a result of public consultation on the proposed zoning order, the Ministry received a total of three (3) comments through the Environmental Registry of Ontario.
Two comments received through the public consultation process were related to the lands being returned to agriculture or preserved as a park. The third comment related to engagement with Chippewas of Kettle & Stony Point First Nation.
All comments reviewed were taken into consideration, prior to a decision being made.

Why consultation isn't required
Part II of the Environmental Bill of Rights Act, 1993 does not apply to proposals to make a Minister’s Zoning Order (MZO) under subsection 47(1) of the Planning Act, or to amend or revoke an MZO under subsection 47(8) of the Planning Act.
Although not required, the ministry is providing public notice of this request for consultation.
Proposal details
Take notice that the Minister of Municipal Affairs and Housing has received a request from the Minister of Economic Development, Job Creation and Trade to consider making a zoning order in the City of St. Thomas under subsection 47(1)(a) of the Planning Act.
A zoning order regulates the use of land and the erection, location and use of structures on the land.
The purpose of this zoning order is to permit the development of a gigafactory and industrial park on the subject lands. Portions of the lands are proposed to be rezoned from “Open Space” and “Natural Heritage” to “Employment Lands”. A portion of the site would remain zoned “Natural Heritage”.
This zoning order has been requested to facilitate the development of an electric vehicle battery manufacturing plant and an industrial park which is proposed to include associated supply chain and other businesses and industries.
The proposed zoning order would apply to those lands as shown on the map identified below.
We invite members of the public, municipal partners, proponents and other stakeholders to share your feedback on this proposal and welcome any information that may help to inform potential future decisions about these zoning orders. If made, this zoning order would be applicable law as of its effective date.
