On December 20, 2024, the Minister of Municipal Affairs and Housing revoked Ontario Regulation (O. Reg.) 337/22. The Ministry of Infrastructure requested that the Minister consider revoking the regulation.

Decision details

Pursuant to subsection 47(8) of the Planning Act, Ontario Regulation 562/24 revokes a Zoning Order, Ontario Regulation 337/22. Ontario Regulation 337/22 was made on April 8, 2022, and permitted a transit-oriented community adjacent to the Mimico GO Station on lands known municipally as 315 and 327 Royal York Road, and 27, 33 and 39 Newcastle Street, in the City of Toronto. The request was received from the Minister of Infrastructure.

Effects of consultation

All comments received were taken into consideration prior to a decision being made. The comments received as summarized below:

  • A submission from Kingsett Capital (which has a controlling interest in 315 and 327 Royal York Road) fully supports the proposed revocation.
  • An advisor to the court-appointed Receiver of 39 Newcastle Street, Osmington Gerofsky Development Corporation, indicated it is carefully reviewing the proposed revocation and seeks additional time to engage in meaningful and comprehensive discussions with all relevant stakeholders involved in the decision-making process, prior to the revocation.
  • A board member for the Mimico Residents Association expressed support for the proposed revocation such that it will make it easier for a replacement project to advance similar to what was agreed to in the original Van Dyk agreement.
  • Other submissions expressed concerns with:
    • the use of MZOs for TOC
    • the wasting of tax dollars,
    • the appearance of limiting the ability to build housing on the property, and building on green space.

Why consultation isn't required

Part II of the Environmental Bill of Rights Act, 1993, does not apply to proposals to make a Minister’s Zoning Order (MZO) under subsection 47(1) of the Planning Act, or to amend or revoke an MZO under subsection 47(8) of the Planning Act.

Although not required under the Environmental Bill of Rights Act, 1993, the Ministry is providing public notice of the request for a revocation through the Environmental Registry of Ontario.

Take notice that the Minister of Municipal Affairs and Housing, under subsection 47(8) of the Planning Act, is consulting on a proposal to revoke a Zoning Order, Ontario Regulation 337/22.Ontario Regulation 337/22 was made on April 8, 2022, and permits a transit-oriented community adjacent to the Mimico GO Station on lands known municipally as 315 and 327 Royal York Road, and 27, 33 and 39 Newcastle Street, in the City of Toronto. The request was received from the Minister of Infrastructure.

To help ensure decisions are made in a transparent manner and support government priorities, the Ministry is seeking feedback on whether this request should be considered and any additional information that may help inform a decision.
