Bulletin summary

The Resource Productivity and Recovery Authority released its 2017 annual report, detailing its oversight activities and audited financial statements.

Why consultation isn't required

The purpose of this notice is to inform interested parties that the Resource Productivity and Recovery Authority's (the Authority) 2017 annual report has been posted on the Authority’s website and tabled before the Legislative Assembly.

This report does not require public consultation as a proposal notice under the Environmental Bill of Rights, 1993 (EBR) as the Ministry of the Environment, Conservation and Parks is not making a decision on this matter, and the Authority, a non-Crown and not for profit corporation, is not prescribed under the EBR.

Section 6.1 (h) of the Transitional Operating Agreement between the Minister of the Environment, Conservation and Parks and the Authority provides that the Minister will post the Authority's annual report on the environmental registry established under the EBR for public information.

Bulletin details

Description

On November 30, 2016, the Resource Recovery and Circular Economy Act, 2016 (RRCEA) and the Waste Diversion Transition Act, 2016 (WDTA), were proclaimed into force.

The RRCEA established the Authority, a non-Crown, and not-for-profit corporation. Under the RRCEA, the Authority is responsible for providing effective oversight, developing and operating a data clearinghouse, and undertaking compliance and enforcement activities related to the new producer responsibility regime. The Authority is also responsible for oversight, compliance and enforcement related to existing waste diversion programs and their wind up under the WDTA.

The legislation includes a number of governance, accountability and transparency measures to help ensure that the Authority operates effectively and that the government has oversight measures consistent with best governance practices. A key accountability measure is the requirement for the Authority to develop an annual report which details its activities under the RRCEA and the WDTA during the previous fiscal year and audited financial statements.

The Authority is required to:

  • Develop its annual report in accordance with section 44 of the RRCEA, section 6 of the WDTA and the transitional operating agreement between the Minister and the Authority; and
  • Provide a copy of the annual report to the Minister and to make the report available to the public on the Authority's Registry by June 1 each year.

Other information

As per section 37 of the RRCEA, the Authority and its members, officers, employees and agents are not agents of the Crown in right of Ontario.

Subsection 44 (2) of the RRCEA requires the Minister to lay a copy of the Authority’s annual report before the Legislatively Assembly as soon as reasonably possible after receiving a copy from the Authority.
