Why consultation isn't required
This notice is to advise that the Resource Productivity and Recovery Authority's (the Authority) 2018 annual report has been posted on the Authority’s website and tabled before the Legislative Assembly.
Public consultation is not required under the Environmental Bill of Rights, 1993 (EBR) because we are not making a decision and the Authority, a non-Crown and not for profit corporation, is not prescribed under the EBR.
Section 6.1 (h) of the Transitional Operating Agreement between the Minister of the Environment, Conservation and Parks and the Authority requires the Minister to post the Authority's annual report on the environmental registry for public information.
2018 Annual report
The Resource Productivity and Recovery Authority (the Authority) released its 2018 annual report, detailing its oversight activities and audited financial statements.
The Authority is a non-Crown and not-for-profit corporation established under the Resource Recovery and Circular Economy Act, 2016 (RRCEA).
Under the RRCEA the Authority provides oversight and is responsible for:
- developing and operating a registry for producers responsible for materials under the RRCEA
- undertaking compliance actions to enforce the requirements set out in the RRCEA and associated regulations
The Authority is also responsible for oversight, compliance and enforcement of existing waste diversion programs and their wind up under the Waste Diversion Transition Act, 2016 (WDTA).
The RRCEA includes governance, accountability and transparency measures to help ensure that the Authority operates effectively and assists government oversight. A key accountability measure is the requirement that the Authority develop an annual report detailing its activities under the RRCEA and the WDTA during the previous fiscal year and provide its audited financial statements.
The Authority is required to:
- develop its annual report in accordance with section 44 of the RRCEA, section 6 of the WDTA and the Transitional Operating Agreement between the Minister and the Authority
- provide a copy of the annual report to the Minister and to make the report available to the public on the Authority's website by June 1 each year

Other important information
Under section 37 of the RRCEA, the Authority and its members, officers, employees and agents are not agents of the Crown in right of Ontario.
Subsection 44 (2) of the RRCEA requires the Minister to table a copy of the Authority’s annual report before the Legislatively Assembly as soon as reasonably possible after receiving a copy from the Authority.
