Bulletin summary

We amended Ontario Regulation 172/03 under the Safe Drinking Water Act, 2002. The amendments to O. Reg. 172/03 have been filed under O. Reg. 209/19. The changes ensure greater alignment with the new “Environmental Compliance Approval in Respect of Sewage Works” regulation, Ontario Regulation 208/19, under the Environmental Protection Act.

Why consultation isn't required

We made administrative amendments to the definition of “municipal drinking water system” in Ontario Regulation 172/03 to ensure greater consistency with the new Environmental Compliance Approval in Respect of Sewage Works regulation, Ontario Regulation 208/19, under the Environmental Protection Act.

These amendments added reference to other forms of ownership transfers of drinking water infrastructure to municipalities through agreements made under the:

  • Planning Act generally (as opposed to just under Part VI)
  • Condominium Act, 1998
  • Developmental Charges Act, 1997

The amendments to O. Reg. 172/03 have been filed under O. Reg. 209/19.

We did not consult on these amendments as they are administrative in nature and we do not expect they will have any significant impact on the environment.

Summary of changes to Ontario Regulation 172/03 (definitions of “deficiency” and “municipal drinking water system”)

We made changes to Ontario Regulation 172/03 to better align with the new Environmental Compliance Approval in Respect of Sewage Works regulation Ontario Regulation 208/19, under the Environmental Protection Act.

Previously, Ontario Regulation 172/03 only referred to ownership transfers of drinking water infrastructure to municipalities in accordance with agreements under Part VI of the Planning Act.

However, ownership of drinking water infrastructure may be transferred to a municipality in accordance with agreements made under the:

  • Planning Act generally
  • Condominium Act, 1998
  • Developmental Charges Act, 1997

The amendments to O. Reg. 172/03 have been filed under O. Reg. 209/19.
