MMAH File No. 54-C-197946 was draft approved on December 12, 2019 with conditions that must be fulfilled prior to final approval being granted.
The approval can be appealed using the procedure outlined below. Notice to appeal the decision to the Local Planning Appeal Tribunal must be filed with the Minister of Municipal Affairs and Housing on or before January 1, 2020.
The proponents have one (1) year to satisfy conditions, otherwise approval will lapse.
Non-standard conditions include:
- That prior to final approval, the Ministry must be advised in writing by the Ingram Local Roads Board that they do not have any concerns related to the construction of a new entrance on Marshall Road.

Appeal process for decisions published before June 1, 2021
You can appeal all or part of this this instrument to the appeal to the Local Planning Appeal Tribunal (LPAT) by submitting a notice of appeal to the Minister of Municipal Affairs and Housing.
There is an additional “leave to appeal” right under the Environmental Bill of Rights.
Who can appeal

A notice of appeal can’t be submitted by:
- an unincorporated association
- an unincorporated group
You can, however, submit a notice of appeal as a member of the unincorporated association or group.
You have to have made an oral submission at a public meeting or a written submission to the council before the official plan amendment was adopted. Note: this is not required if you are appealing a proposal for provisional consent (no official plan in place).

Description of instrument
The purpose of application number 54-C-197946 is to sever approximately 63.94 hectares of land from PIN 61273-0095, north ½ Lot 10, Concession 3, locally known as 243324 Margueratt Road as a lot addition to adjacent lands to the south being PIN 61273-0110, locally known as 113398 Marshall Road. The resulting lot will be 96.92 hectares in size and will be used for agricultural purposes with access from Marshall Road. The proposed retained lot will be 0.8-hectare in size, containing a dwelling and four sheds, on private services. No new buildings or structures are proposed.
