On November 29, 2018, the ministry released the Preserving and Protecting our Environment for Future Generations: A Made-in-Ontario Environment Plan. The plan includes actions to make producers responsible for the waste generated from their products and packaging and their ability to choose how best to meet their diversion obligations.
The Tires Regulation (Ontario Regulation 225/18) is the first individual producer responsibility regulation to be implemented under the Resource Recovery and Circular Economy Act, 2016 and came into effect on January 1, 2019. Tire producers are required to create an accessible and convenient free tire collection network across the province to recover and recycle used tires. The Tires Regulation promotes the reuse and recycling of tires and redesigning them into useful materials instead of stockpiling or disposing them in landfills.
As a result of the regulation creating market conditions to prevent future stockpiles, the risk of mosquito-borne disease resulting from stored tires has been mitigated.

Comments were received however as the government is no longer considering this proposal, the comments did not have an impact on the final decision.

This notice was originally posted in the old Environmental Registry under number RA03E0025.
Description of regulation
The proposed amendment imposes requirements for used tire sites only after a medical officer of health, alone or in concert with a provincial officer, makes a written determination that action is required by the person responsible for the used tire site to decrease the risk of individuals contracting West Nile virus.
This risk is determined through a local assessment in accordance with the document published by the Ministry of Health and Long-Term Care entitled " West Nile Virus Preparedness and Prevention Plan for Ontario" (see link at the end of this notice).
This would be a four step process. The first step is to determine that there is a risk. The next step would be to advise the owner/operator of the used tire site of the risk determination. The owner/operator would then develop their plan to control or prevent mosquito born disease and the last step would be the actual plan implementation.
These requirements would be aimed at reducing the potential breeding ground for mosquitoes. Examples could include a requirement for used tires stored outside to be brought inside for storage while ensuring that fire code standards are adhered to, or, that the used tires are covered in a way that they do not collect water, and organic debris. Site specific requirements would depend on such factors like the quantity of used tires stored, and the site owner's/operator's ability to ensure water and organic debris do not accumulate in them.
Purpose of regulation
The purpose of this proposed amendment to Regulation 347 (General Waste Management) is to require used tire site owners/operators to develop and implement a plan for the prevention or control of mosquito born disease.
Other information
The requirement to develop and implement a plan for the prevention or control of mosquito born disease is applicable to all used tire sites, regardless of size, or quantity of stored tires.
