Why consultation isn't required
Part II of the Environmental Bill of Rights Act, 1993 does not apply to proposal to make a Minister's Zoning Order (MZO) under subsection 47(1) of the Planning Act, or to amend or revoke an MZO under subsection 47(8) of the Planning Act.
Bulletin details
A Zoning Order, made pursuant to clause 47(1)(a) of the Planning Act, regulates the use of land and the erection, location and use of any building or structure on the land.
Ontario Regulation 172/20 will facilitate a proposed housing development (townhouses and apartments) along with associated commercial development on approximately 12 hectares (ha) of land described below.
Ontario Regulation 172/20 applies to:
- approximately 8.5 hectares in the Town of Whitchurch-Stouffville on the west side of Highway 48 and just north of the Hamlet of Dickson Hill.
- approximately 3.5 hectares in the City of Markham on the west side of Highway 48 and just north of the Hamlet of Dickson Hill.

Pursuant to the subsection 47(4) Planning Act, and except for the purposes of section 24, the Minister deemed Ontario Regulation 172/20 to be and to always have been a by-law passed by the council of the Town of Whitchurch-Stouffville and the council of the City of Markham.
