Bulletin summary

On July 8, 2020, the Minister of Municipal Affairs and Housing filed a Zoning Order with the Registrar of Regulations as Ontario Regulation 355/20 to permit new mixed-use development in the City of Kawartha Lakes. We wanted to inform you of this decision even though we are not required to under the Environmental Bill of Rights, 1993.

Why consultation isn't required

Part II of the Environmental Bill of Rights Act, 1993 does not apply to a proposal to make a Minister's Zoning Order (MZO) under subsection 47(1) of the Planning Act, or to amend or revoke an MZO under subsection 47(8) of the Planning Act.

Bulletin details

A Zoning Order, made pursuant to clause 47(1)(a) of the Planning Act, regulates the use of land and the erection, location and use of any building or structure on the land. The Minister's Zoning Order was made based on a request from the City of Kawartha Lakes.

Ontario Regulation 355/20 will facilitate a proposed development of 563 new residential dwellings consisting of a mix of housing types including: single and semi- detached homes, duplex, triplex, fourplex dwellings, and townhouse blocks. The Zoning Order also facilitates the development of community parks, an elementary school, and uses associated with these permitted uses.

Ontario Regulation 355/20 applies to approximately 39.56 hectares (97.75 acres) of land at the north east corner of Highway 35 and Colborne Street, in the former Town of Lindsay in the City of Kawartha Lakes. The lands are legally described as part of Lot 22 Concession 4, which are also identified on Map No. 242, filed at the Ministry of Municipal Affairs and Housing.

p>Pursuant to the subsection 47(4) Planning Act, and except for the purposes of section 24, the Minister deemed Ontario Regulation 355/20 to be and to always have been a by-law passed by the council of the City of Kawartha Lakes.
