Why consultation isn't required

On April 1, 2020, the Ontario Government made a temporary regulation to respond to the COVID-19 outbreak. Ontario Regulation 115/20 exempts all proposals for policies, acts, regulations and instruments from posting requirements under the EBR until 30 days after the declared emergency is terminated.

Ontario Regulation 115/20 was revoked on June 15, 2020, however, we are posting this decision as a bulletin because the proposal was posted on April 3, 2020 while Ontario Regulation 115/20 was in effect.

Although consultation was not required, the ministry did consult with the public on this proposal by posting ERO 019-1543 for public comment from April 3 – May 4, 2020. To ensure transparency, the ministry is providing details of its decision and the effects of consultation on decision-making in this notice.

This site is Aggregate Resources Act (ARA) licence No. 80956 which is located southwest of Orangeville.

Instrument decision details

A change to the site plan of Aggregate Resources Act Licence No. 80956 was approved by the Minister on August 18, 2020.   

The site plan has been amended to allow for the following changes:

  • revise the rehabilitation plan to reflect the removal of the setbacks
  • amend the area of extraction to reflect the increased extraction area as a result of the proposed reduction of the setbacks
  • it is proposed that all tonnage removed from this licenced site, the adjacent ARA Licence No. 10606 and the proposed Greenwood East and Greenwood West pits be combined for total annual tonnage of 2,000,000 tonnes
  • add conditions to the site plan specifying:
    • requirements for species at risk surveys prior to land clearing and the timing of site activity
    • defining the hours of operations at the site as 6 a.m. to 6 p.m. Monday to Friday and 7 a.m. to 12 noon Saturday
    • the conditions under which importation of aggregate and imported fill will be permitted
    • a maximum disturbed area of 81 ha for this site and adjacent licence ARA No.10606
    • the location of fuel storage
    • mitigation measures for dust control, complaint protocol, ground water monitoring, back-up alarms and a spill contingency plan
  • update the existing features page of the site plan to indicate the berm location and zoning of adjacent lands
  • removal of the reference to a mid-19th century Euro-Canadian archaeological site and the associated setback based on the findings of additional field work that was completed
  • identify the location of the Townline Road widening on the site plan

This proposal was originally posted as a s. 13(2) – ‘Changes to the conditions of a licence to operate a pit or quarry’ in error; the changes were intended to be made to the conditions of the site plan.

No comments were received in response to the Environmental Registry notice.

No comments were received in response to the Aggregate Resources Actconsultation process.

Third parties are not able to apply for leave to appeal in respect of proposals which are posted while Ontario Regulation 115/20 is in effect.

On April 1, 2020, the Ontario Government made a temporary regulation to respond to the COVID-19 outbreak which exempts all proposals from the requirement to post notices on the ERO. Leave to appeal may only be sought in respect of instruments that are required to be posted to the ERO.
