Bill 213 (Better for People, Smarter for Business Act, 2020) received Royal Assent on December 7, 2020

Bulletin summary

The Minister of Small Business and Red Tape Reduction has proposed the Better for People, Smarter for Business Act, 2020, which features a wide range of items that cut across themes and ministries. Items in the package will reduce the number of requirements and the cost of doing business in the province, to support economic recovery.

Why consultation isn't required

The proposed Better for People, Smarter for Business Act, 2020 is a package of legislative changes led by the Ministry of Economic Development, Job Creation and Trade (MEDJCT). However, MEDJCT does not have responsibility for any legislative amendments in the package that would have a significant effect on the environment.

Ministries responsible for legislation in this package are undertaking public consultation, as required under the Environmental Bill of Rights (EBR) for amendments that could, if implemented, have a significant effect on the environment.

As the proposed amendments within the bill are from 10 ministries, the ministries are responsible to evaluate their individual proposed legislative amendments against the requirements from the EBR. Where there are potential environmental impacts, the individual ministries have completed a proposal notice to which it has been posted on the environmental registry.

As MEDJCT-SBRTR is compiling the proposed legislative amendments on behalf of the 10 ministries, MEDJCT-SBRTR’s bulletin notice contains an index of these proposal notices for informational purposes only.

Bulletin details

General

The amendments contained in the proposed Better for People, Smarter for Business Act, 2020 will focus on the removal of barriers in order to stimulate Ontario's economic recovery. The package will:

  • make changes that place more opportunities within the reach of businesses
  • allow for the creation and retention of good jobs
  • improve the quality of life in every community across the province.

Out of the 29 individual Acts, three Acts from three ministries have determined amendments to their individual legislation may result in a significant environmental impact and have posted proposal notices on the Environmental Registry. Summary of Proposed Notices:

Ministry: Ministry of Energy, Northern Development and Mines

Act: Mining Act

Summary of amendment(s):

The Ministry is proposing amendments to the Mining Act to allow the Minister to provide blanket exclusions of time and/or exceptions for assessment work, allow for the Ministry to annul the forfeiture of a boundary claim, and allow the Minister to waive the requirement to pay interest on late payments for exchange leases. In addition, the Ministry is proposing amendments to the Act to provide the Minister with authority to include gap lands - small gaps of land between mining claims - in a lease issued under the Act, provide mining claim lessees the ability to apply for a renewal of their mining lease online through the Mining Land Administration System, and fix an erroneous cross-reference.

Act: Fish and Wildlife Conservation Act, 1997

Summary of amendment(s):

The Ministry of Natural Resources and Forestry is proposing to modernize and streamline the regulatory framework for Ontario’s aquaculture facilities through a series of changes designed to address the range and risks associated with Ontario’s growing and diverse aquaculture operations.

Summary of amendment(s):

The proposed changes to the Ontario Water Resources Act would give local host municipalities more direct input on decisions to allow bottled water companies to withdraw new or increased amounts of groundwater in their communities. Below is a list of related links;
