Why consultation isn't required
Part II of the Environmental Bill of Rights Act, 1993 does not apply to proposal to make a Minister's Zoning Order under subsection 47(1) of the Planning Act, or to amend or revoke a Minister's Zoning Order under subsection 47(8) of the Planning Act.

A Zoning Order, made pursuant to clause 47(1)(a) of the Planning Act regulates the use of land and the erection, location and use of any building and structure on the land.
O. Reg. 160/21 facilitates the development of 15 affordable housing units. It provides relief from certain zoning requirements by permitting a multiple dwelling within the portion of the ground floor of the existing building that has frontage on Main Street East. It also provides that access to the multiple dwelling shall be from the Main Street East frontage.
O. Reg. 160/21 applies to lands municipally known as 350 King Street East located in the City of Hamilton. For illustrative purposes, the lands are shown in the map the link to which is set out below.
Pursuant to subsection 47(4) of the Planning Act, and except for the purposes of section 24, the Minister deemed O. Reg. 160/21 to be and to always have been a by-law passed by the council of the City of Hamilton.
