Decision details
The Minister of Municipal Affairs and Housing made a decision on June 21, 2021 to approve Simcoe County Official Plan Amendment 5-Waste Management policies with one modification. The last day to appeal this decision on File # 43-OP-200446 is July 12, 2021.
The purpose of OPA 5 is to clarify the County’s policies regarding its Solid Waste Management System (e.g., landfills and permanent storage of waste, recycling facilities and organic processing facilities), update definitions related to waste management activities in the County’s Official Plan and update how solid waste management sites are identified on Official Plan schedules. As a result, OPA 5 intends to streamline County and local planning approvals with respect to the siting and expansion of non-landfilling activities. One modification was required to OPA Schedule 5.6.2 due to minor mapping updates for two Waste Disposal sites (#551,635) located in Tiny Township.

Effects of consultation
As a result of the 30-day public consultation commenting period posted to the Environmental Registry of Ontario (ERO) under #019-3292, a total of 71 submissions were received. Generally, these submissions noted concern with respect to the proposal to remove the requirement for a County official plan amendment for the siting or expansion of non-landfilling waste management activities.
All public and stakeholder comments received through this ERO posting were carefully considered in the decision to approval the County of Simcoe OPA 5, as modified. In response to concerns outlined in submissions, it is recognized that local planning approval requirements will trigger the need for statutory public consultation which will appropriately address outlined concerns with respect to County OPA 5.

Appeal process for decisions published before June 1, 2021
You can appeal all or part of this this instrument to the appeal to the Local Planning Appeal Tribunal (LPAT) by submitting a notice of appeal to the Minister of Municipal Affairs and Housing.

A notice of appeal can’t be submitted by:
- an unincorporated association
- an unincorporated group

You have to have made an oral submission at a public meeting or a written submission to the council before the official plan amendment was adopted. Note: this is not required if you are appealing a proposal for provisional consent (no official plan in place).

Proposal details
The County of Simcoe Council (“County”) adopted OPA 5 on February 9th, 2021 and, pursuant to section 17(1) and section 21(1) of the Planning Act, it is before the Minister of Municipal Affairs and Housing for a decision.
OPA 5 proposes to clarify the County’s policies regarding its Solid Waste Management System (e.g., landfills and permanent storage of waste, recycling facilities and organic processing facilities), update definitions related to waste management activities in the County’s Official Plan and update how solid waste management sites are identified on Official Plan Schedules.
The proposed OPA has regard for various matters of provincial interest, specifically the adequate provision and efficient use of waste management systems and the minimization of waste which supports the development of healthy, livable safe communities.
All comments received prior to the posting deadline will be considered as part of the decision-making process by the Ministry if they are submitted by mail or electronically through this Environmental Registry posting. If submitting comments by mail, please reference this posting's ERO (Environmental Registry of Ontario) number 019-3292.
Comments must be submitted within the time restrictions of this notice to be considered prior to a final decision by the Minister of Municipal Affairs and Housing ("Minister"). The Minister may refuse the OPA, approve the OPA in whole or in part, or approve the OPA with modifications.
