Bulletin summary

On March 5, 2021, the Minister of Municipal Affairs and Housing filed a Zoning Order, made pursuant to clause 47(1)(a) of the Planning Act, with the Registrar of Regulations as Ontario Regulation (O. Reg.) 167/21. The Municipality of Clarington requested that the Minister consider making a Zoning Order.

Why consultation isn't required

Part II of the Environmental Bill of Rights Act, 1993 does not apply to proposal to make a Minister's Zoning Order under subsection 47(1) of the Planning Act, or to amend or revoke a Minister's Zoning Order under subsection 47(8) of the Planning Act.

Bulletin details

A Zoning Order, made pursuant to clause 47(1)(a) of the Planning Act, regulates the use of land and the erection, location and use of any building or structure on the land.

O. Reg. 167/21 permits the development of a building centre and accessory uses including: a building supply outlet, garden and nursery sales and supply establishment and outside storage area, on the lands noted below.

O. Reg. 167/21 applies to lands municipally known as 2423 Rundle Road on the southeast corner of Regional Highway 2 and Rundle Road in the Municipality of Clarington. The lands are legally described as Part of Lot 22, Concession 2, Darlington, designated as Parts 1 and 2 on Reference Plan 10R-936, and further identified by Property Identification Number 26610-0041 (LT) registered in the Land Registry Office for the Land Titles Division of Durham (No. 40).For illustrative purposes, the lands are shown in the map the link to which is set out below.

Pursuant to subsection 47(4) of the Planning Act, and except for the purposes of section 24, the Minister deemed O. Reg. 167/21 to be and to always have been a by-law passed by the council of the Municipality of Clarington.
