Bulletin summary

A decision was made to approve a site-specific amendment to remove certain lands in the City of Richmond Hill from the Parkway Belt West Plan (PBWP) and the associated Minister's Zoning Order (MZO), filed as Ontario Regulation 474/73.

The PBWP amendment is approved as Amendment No. 239 and the MZO amendment is filed as Ontario Regulation 226/22.

Why consultation isn't required

Part II of the Environmental Bill of Rights Act, 1993 does not apply to proposals to make a Minister's Zoning Order (MZO) under subsection 47(1) of the Planning Act, or to amend or revoke an MZO under subsection 47(8) of the Planning Act.

Bulletin details

The lands subject to this amendment are municipally known as 8755 Bathurst Street, which are located on the east side of Bathurst Street and north of Highway 7 in the City of Richmond Hill. The lands are legally described as part of Lots 36 to 38, Concession 1, West of Yonge Street, as identified by Property Identification Numbers; 03215-1210 (LT);03215-0982(LT); 03215-0987(LT); and 03215-1212(LT). The lands removed are approximately 43 hectares (105 acres) in size.

The above noted lands were removed from the Minister’s Zoning Order, filed as Ontario Regulation 474/73, through Amending Regulation 226/22 and from the Parkway Belt West Plan through Amendment no. 239 to facilitate future development.

The Parkway Belt West Plan is a provincial development plan created in 1978 that provides for development of a multipurpose infrastructure corridor, urban separator and linked open space system across the abbr title="Greater Toronto Area">GTA. The process to amend the Parkway Belt West Plan is provided in the Ontario Planning and Development Act, 1994.

The Minister Zoning Order, filed as Ontario Regulation 474/73, was made in 1973 to implement the Parkway Belt West Plan. The Zoning Order generally only permits low impact land uses including agricultural uses, and accessory buildings, and structures that will be used for agricultural operations. Section 47(8) of the Planning Act allows the Minister of Municipal Affairs and Housing to amend or revoke a Minister’s Zoning Order.
