A decision was made to revoke a Minister’s Zoning Order (MZO) that applied to lands added to the City of Stratford (formerly in the Township of Perth South, County of Perth), filed as Ontario Regulation 356/20.

Why consultation isn't required

Part II of the Environmental Bill of Rights Act, 1993 does not apply to proposal to make a Minister's Zoning Order (MZO) under subsection 47(1) of the Planning Act, or to amend or revoke an MZO under subsection 47(8) of the Planning Act.

Bulletin details

Ontario Regulation 356/20 has been revoked and is no longer in effect. This means that land use planning permissions allowing a float glass manufacturing facility on lands annexed by the City of Stratford are no longer in force.

The zoning order (MZO), filed on July 8, 2020 as Ontario Regulation 356/20, was made based on the request of the City of Stratford, Township of Perth South, and County of Perth. It permitted manufacturing, processing, fabrication, assembly, distribution and storage of raw materials relating to the manufacturing of float glass and accessory uses on the subject lands. On March 11, 2021, the City of Stratford wrote to the Minister of Municipal Affairs and Housing and formally requested that the MZO be revoked. The Township of Perth South also supported the City of Stratford’s revocation request.

Section 47 of the Planning Act allows the Minister of Municipal Affairs and Housing to amend or revoke a MZO. Notice must be given prior to a decision being made regarding the revocation of a MZO, as required under subsection 47(9) of the Act.

The Ministry of Municipal Affairs and Housing published notice in the Stratford Beacon Herald on April 7, 2021, inviting comments from the public for a period of 30 days on the proposal to revoke the MZO. Comments were received from the public and were considered in making the decision to revoke the MZO.
