Why consultation isn't required
Part II of the Environmental Bill of Rights Act, 1993 does not apply to proposal to make a Minister's Zoning Order (MZO) under subsection 47(1) of the Planning Act, or to amend or revoke an MZO under subsection 47(8) of the Planning Act.

A Zoning Order, made pursuant to clause 47(1)(a) of the Planning Act, regulates the use of land and the erection, location and use of any building or structure on the land.
O. Reg. 549/21 applies to lands municipally known as 2175 Cornwall Road. For illustrative purposes, the Subject Lands are shown in the map, the link to which is set out below.
O. Reg. 549/21 limits the gross floor area of the existing building to 29,200 square metres and the total number of parking spaces to 689.
Pursuant to subsection 47(4) of the Planning Act, and except for the purposes of section 24, the Minister deemed O. Reg. 549/21 to be and to always have been a by-law passed by the Council of the Town of Oakville.
In addition, privately-initiated applications submitted to the Ministry of Municipal Affairs and Housing to remove O. Reg. 481/73 and the Parkway Belt West Plan from the Subject Lands have been approved. The Parkway Belt West Plan amendment was approved on July 29, 2021 as Amendment NO. 231 and an order amending O. Reg. 481/73 was filed on July 30, 2021 as O. Reg. 548/21. O. Reg. 481/73 and the Parkway Belt West Plan no longer apply to the Subject Lands.
