Original proposal
Why consultation isn't required
Under the Environmental Bill of Rights, this proposal does not require consultation as there are no anticipated potentially significant environmental impacts with the proposed amendment. However, given the environmental significance of the Mining Act, the ministry is voluntarily posting this notice for comment.
Proposal details
Part VII of the Mining Act and O. Reg. 240/00 provide Ontario’s framework for the rehabilitation of mining lands, including the requirement for advanced exploration and mine production closure plans and associated financial assurance. The proposal to amend the name of O. Reg. 240/00 would include a reference to advanced exploration closure plans and, reflect the graduated approach to advanced exploration and mine production closure planning. Stakeholders expressed concerns that closure plan regulations do not address different scales of operations and that this causes confusion and burden for the mining industry. This name change would support ongoing work to develop guidance documents and to pursue further regulatory amendments that strengthen a graduated approach to closure planning. This change to the name of the regulation has no regulatory impact and no relationship to compliance costs. The Ministry considers the proposed name to be more descriptive. There are no costs to businesses. |
