Update Announcement

Bill 13 (Supporting People and Businesses Act, 2021) received Royal Assent on December 2, 2021.

Bulletin summary

The Associate Minister of Small Business and Red Tape Reduction (SBRTR) has introduced the Bill 13, the Supporting People and Businesses Act, 2021 which is designed to reduce burden on individuals and businesses. Measures will aid in weathering the impacts of COVID-19 and help build a more efficient Ontario for people and businesses.

Why consultation isn't required

The proposed Supporting People and Businesses Act, 2021 is a package of legislative changes led by the Ministry of Economic Development, Job Creation and Trade (MEDJCT). However, MEDJCT does not have responsibility for any legislative amendments in the package that would have a significant effect on the environment.

Ministries responsible for legislation in this package are undertaking public consultation, as required under the Environmental Bill of Rights (EBR) for amendments that could, if implemented, have a significant effect on the environment.

Proposed amendments within the bill are from 13 ministries that are responsible for evaluating their individual legislative proposals and amendments against the public consultation requirements of the EBR. Where there is potential environmental impact, the responsible ministry has completed a proposal notice to which it has been posted on the environmental registry.

There are proposals in this Bill that do not have significant impact on the environment by may impact businesses. Opportunities to comment on these additional proposals are available on Ontario’s Regulatory Registry.

Bulletin details

The amendments contained in the proposed Supporting People and Businesses Act, 2021 will focus on reducing red tape and helping to build a more efficient Ontario for people and businesses coming out of the COVID-19 pandemic. Areas of focus include:

  • making Ontario more competitive
  • supporting tourism and local recovery
  • boosting rural and northern economies
  • making health services a priority across sectors

Ministry: Ministry of the Environment, Conservation and Parks

Act: Environmental Assessment Act

Title of notice: Clarifying the authority to change the classes of projects to which a class environmental assessment process applies. 

Summary of amendment(s):

We are proposing a minor amendment to the Environmental Assessment Act to make it clearer that the authority to amend a Class Environmental Assessment (Class EA) and a Class EA approval, includes changing the types (or classes) of projects that can follow a Class EA.

Title of notice: Proposed Additional Delegation of Planning Decisions

Summary of amendment(s):

Changes are being proposed to the Planning Act, Municipal Act, 2001 and City of Toronto Act, 2006 that would provide municipalities with discretionary authority to delegate additional decisions to committees of council or municipal staff for minor amendments to zoning by-laws.

Summary of amendment(s):

We are proposing amendments to the Mining Act to support the recovery of minerals from waste at current operating, closed or abandoned mine sites in Ontario through reprocessing of minerals, including critical minerals.

Act:  Mining Act, 1990

Title of notice: Retention of Proceeds from Testing Activities on Leases and Patented Lands

Summary of amendment(s):

We are proposing amendments to the Mining Act to allow lessees, licensees and owners of mining lands to sell and retain the proceeds from materials extracted for the purposes of testing without the requirement for a mine production closure plan to have first been filed.
