The decision that is subject to this leave to appeal is the Director's decision to issue a Certificate of Property Use to the Corporation of the City of Guelph for 200 Beverley Street, Guelph, Ontario.
642762 Ontario Inc. seeking leave to appeal on the grounds that the Director's decision is unreasonable and could result in significant harm to the environment. Specifically, contamination has and continues to migrate from the City of Guelph property at 200 Beverley onto neighbouring properties well above the MECP Standards. The CPU does not require the City of Guelph to take any steps to stop the migration of contamination above the Ministry Standards onto neighbouring properties, impacting the environment and human health.
