Bulletin summary

On December 3, 2021, the Minister of Municipal Affairs and Housing filed a Zoning Order, made pursuant to clause 47(1)(a) of the Planning Act, with the Register of Regulations as Ontario Regulation 822/21. The City of Guelph requested that the Minister consider making the Zoning Order.

Why consultation isn't required

Part II of the Environmental Bill of Rights Act, 1993 does not apply to proposal to make a Minister's Zoning Order (MZO) under subsection 47(1) of the Planning Act, or to amend or revoke an MZO under subsection 47(8) of the Planning Act.

Bulletin details

A Zoning Order, made pursuant to clause 47(1)(a) of the Planning Act, regulates the use of land and the erection, location and use of any building or structure on the land.

O. Reg. 822/21 comes into effect on January 1, 2022. This order provides relief from certain zoning requirements to facilitate residential development.

O. Reg. 822/21 applies to lands municipally known as the Dolime Quarry primarily located in the Township of Guelph/Eramosa in the County of Wellington, bordered to the northwest, northeast, and southeast by the City of Guelph (Subject Lands). Effective January 1, 2022, the parts of the Subject Lands within the Township of Guelph/Eramosa in the County of Wellington will become part of the City of Guelph. For illustrative purposes, the subject lands are shown in reference map 273, the link to which is set out below.

Pursuant to subsection 47(4) of the Planning Act, and except for the purposes of section 24, the Minister deemed O. Reg. 822/21 to be and to have always been a by-law passed by the Council of the City of Guelph.
