On January 28, 2022, the Minister of Municipal Affairs and Housing filed a Zoning Order, made pursuant to clause 47(1)(a) of the Planning Act with the Registrar of Regulations as Ontario Regulation 40/22 to permit residential uses, commercial uses, institutional uses and new parks in the City of Kawartha Lakes.

Why consultation isn't required

Part II of the Environmental Bill of Rights Act, 1993 does not apply to proposals to make a Minister's Zoning Order (MZO) under subsection 47(1) of the Planning Act, or to amend or revoke an MZO under subsection 47(8) of the Planning Act.

Bulletin details

A Zoning Order, made pursuant to clause 47(1)(a) of the Planning Act, regulates the use of land and the erection, location and use of any building or structure on the land. The Minister’s Zoning Order was made based on a request from the City of Kawartha Lakes.

Ontario Regulation 40/22 facilitates development of approximately 2,250 new residential units, commercial uses, institutional uses and new parks, and also protects existing environmental features and hazardous lands from development.

Ontario Regulation 40/22 applies to three sites totaling approximately 140 hectares of land located generally south of the Town of Lindsay and locally known as Callaghan sites, Gateway site and Angeline site. The lands are legally described as Part of the West Half of Lot 16, Part of Lots 16-17, Part of the East and West Halves of Lot 18, Concession 6; Part of Lot 16, Part of the South Half of Lot 17, Concession 5 in the City of Kawartha Lakes. For illustrative purposes, the subject lands are shown in a location map, the link to which is set out below.

Pursuant to subsection 47(4) of the Planning Act and except for the purposes of section 24, the Minister deemed Ontario Regulation 40/22 to be and to always have been a by-law passed by the Council of the City of Kawartha Lakes.
