Why consultation isn't required
Part II of the Environmental Bill of Rights Act, 1993 does not apply to proposals to make a Minister's Zoning Order (MZO) under subsection 47(1) of the Planning Act, or to amend or revoke an MZO under subsection 47(8) of the Planning Act.
Bulletin details
A Zoning Order Amendment, made pursuant to clause 47(8) of the Planning Act, regulates the use of land and the erection, location and use of any building or structure on the land.
O.Reg. 164/22 adds an additional parcel of land to a previously filed MZO (O. Reg 169/21) and provides relief from certain zoning requirements to facilitate the development of a long term care facility, 600 affordable housing for seniors, and a training centre for personal support workers.
O.Reg. 164/22 applies to lands municipally known as 8885 Woodbine Avenue in the City of Markham. For illustrative purposes, the subject lands are shown in reference map 303, the link to which is set out below.
On January 27, 2022, the government posted the amendment in a local newspaper, the Markham Economist & Sun, for public consultation. Notice was also given in French and published in Toronto L’express on January 28, 2022. The commenting period closed on February 28, 2022. No comments were received during the 30-day commenting period.
