Bulletin summary

On April 1, 2022, the Minister of Municipal Affairs and Housing filed a Zoning Order, made pursuant to clause 47(1)(a) of the Planning Act, with the Registrar of Regulations as Ontario Regulation 251/22. The purpose of the Order is to protect environmentally sensitive lands, including provincially significant wetlands, in the Town of Georgina.

Why consultation isn't required

Part II of the Environmental Bill of Rights Act, 1993 does not apply to proposals to make a Minister's Zoning Order (MZO) under subsection 47(1) of the Planning Act, or to amend or revoke an MZO under subsection 47(8) of the Planning Act.

Bulletin details

A Zoning Order, made pursuant to clause 47(1)(a) of the Planning Act, regulates the use of land and the erection, location and use of any building or structure on the land.

O. Reg.251/22 identifies an Environmental Protection Area and restricts permitted uses to forest, fish and wildlife management conservation and flood or erosion control projects; infrastructure; and passive recreation uses. Buildings and structures associated with the aforementioned uses are also permitted.

O. Reg. 251/22 applies to approximately 360 hectares of land in the Town of Georgina, situated northwest of the intersection of Boyers Road and Woodbine Avenue. For illustrative purposes, the subject lands are shown in on a location map, the link to which is set out below.

In tandem with O. Reg. 251/22, the Minister has also made an Order to designate parts of a registered plan of subdivision in this area to be deemed not registered. Please see ERO Notice 019-5235 for more information.
