Bulletin summary

On March 4, 2022, the Minister of Municipal Affairs and Housing filed an Amendment to O. Reg. 771/21, made pursuant to clause 47(8) of the Planning Act with the Registrar of Regulations as O. Reg. 163/22 to add 65.5 hectares of land to the Zoning Order. The City of Kawartha Lakes requested that the Minister consider amending the Zoning Order.

Why consultation isn't required

Part II of the Environmental Bill of Rights Act, 1993 does not apply to proposals to make a Minister's Zoning Order (MZO) under subsection 47(1) of the Planning Act, or to amend or revoke an MZO under subsection 47(8) of the Planning Act.

Bulletin details

A Zoning Order Amendment, made pursuant to clause 47(8) of the Planning Act, regulates the use of land and the erection, location and use of any building or structure on the land.

O. Reg. 771/21 was filed on November 15, 2021 to facilitate the development of approximately 1,200 new residential units (including seniors-oriented development and rental apartment units), commercial uses, institutional uses, trail system and new parks on approximately 120 hectares of land located east of the community of Lindsay.

The amendment to Zoning Order O. Reg. 771/21, filed as O. Reg. 163/22, adds 65.5 hectares of land to the lands subject to this Zoning Order to facilitate the development of an additional 45 rental apartment units and 1,900 units of mixed housing types. The lands subject to the Zoning Order, as amended are legally described as Part of Lots 19, 20, 21 & 22, Concession 7 in the City of Kawartha Lakes. For illustrative purposes, the subject lands are shown in a location map, the link to which is set out below.

Pursuant to subsection 47(4) of the Planning Act and except for the purposes of section 24, the Minister deemed O. Reg. 771/21, as amended to be and to always have been a by-law passed by the Council of the City of Kawartha Lakes.
