Why consultation isn't required
Part II of the Environmental Bill of Rights Act, 1993 does not apply to proposals to make a Minister's Zoning Order (MZO) under subsection 47(1) of the Planning Act, or to amend or revoke an MZO under subsection 47(8) of the Planning Act.
Bulletin details
A Zoning Order, made pursuant to clause 47(1)(a) of the Planning Act, regulates the use of land and the erection, location and use of any building or structure on the land.
Ontario Regulation 159/22 facilitates industrial, commercial and park uses on the subject lands, and assists the City of Kingston in retaining a start-up company in green technology sector.
Ontario Regulation 159/22 applies to lands locally known as the Clogg’s Road Business Park (at 2800 and 3001 Clogg’s Road), totalling approximately 80 acres in size, and are legally described as Part of Lots 8-11, Concession 4, City of Kingston. For illustrative purposes, the subject lands are shown in a location map, the link to which is set out below.
Pursuant to subsection 47(4) of the Planning Act and except for the purposes of section 24, the Minister deemed Ontario Regulation 159/22 to be and to always have been a by-law passed by the Council of the City of Kingston.
