Bulletin summary

On April 1, 2022, the Minister of Municipal Affairs and Housing filed a Zoning Order, made pursuant to clause 47(1)(a) of the Planning Act with the Registrar of Regulations as Ontario Regulation 250/22. The Township of Cavan Monaghan requested that the Minister consider making the Zoning Order.

Why consultation isn't required

Part II of the Environmental Bill of Rights Act, 1993 does not apply to proposals to make a Minister's Zoning Order (MZO) under subsection 47(1) of the Planning Act, or to amend or revoke an MZO under subsection 47(8) of the Planning Act.

Bulletin details

A Zoning Order, made pursuant to clause 47(1)(a) of the Planning Act, regulates the use of land and the erection, location and use of any building or structure on the land.

Ontario Regulation 250/22 facilitates development of approximately 786 new dwelling units of which about 80 units will be affordable, apartment dwellings in 4-storey mixed-use buildings, 201 townhome dwellings, and about 505 detached units, as well as permits commercial/mixed uses on 5.25 hectares of lands, parks and trails, and stormwater management facilities and future wastewater treatment facilities.>

Ontario Regulation 250/22 applies to four properties, totaling approximately 83 hectares in size and located along Fallis Line, east and west of the community of Millbrook. The lands are legally described as Part of Lots 11 and 13, Concession 5; and Part of Lot 13, Concession 6, Township of Cavan Monaghan, County of Peterborough. Pursuant to subsection 47(4) of the Planning Act and except for the purposes of section 24, the Minister deemed Ontario Regulation 250/22 to be and to always have been a by-law passed by the Council of the Township of Cavan Monaghan.
