Why consultation isn't required
Part II of the Environmental Bill of Rights Act, 1993 does not apply to proposals to make a Minister's Zoning Order (MZO) under subsection 47(1) of the Planning Act, or to amend or revoke an MZO under subsection 47(8) of the Planning Act.

A Zoning Order, made pursuant to clause 47(1)(a) of the Planning Act, regulates the use of land and the erection, location and use of any building or structure on the land.
O. Reg. 329/22 provides permissions for a range and mix of residential, commercial, and institutional uses to support the development of a Transit-Oriented Community. Specifically, the Zoning Order provides for a maximum gross floor area for non-residential uses of 935,000 square metres and a maximum gross floor area for residential uses of 1,187,000 square metres.
O. Reg. 329/22 applies to lands municipally known as 21 Don Roadway, 30 Booth Avenue, and 375 and 385 Eastern Avenue, in the City of Toronto. For illustrative purposes, the subject lands are shown in reference map 290, the link to which is set out below.
Pursuant to subsection 47(4) of the Planning Act, and except for the purposes of section 24, the Minister deemed O. Reg. 329/22 to be and to always have been a by-law passed by the Council of the City of Toronto.
