Why consultation isn't required
Part II of the Environmental Bill of Rights Act, 1993 does not apply to proposals to make a Minister's Zoning Order (MZO) under subsection 47(1) of the Planning Act, or to amend or revoke an MZO under subsection 47(8) of the Planning Act.

A Zoning Order Amendment, made pursuant to clause 47(8) of the Planning Act, regulates the use of land and the erection, location and use of any building or structure on the land.
The amendment to the Zoning Order O. Reg. 355/20, filed as O. Reg. 457/22, removes the gross floor area maximums to facilitate a range of housing forms and densities. O. Reg. 457/22 is the second amending regulation to O. Reg. 355/20.>
On March 5, 2021, O. Reg. 168/21 amended O. Reg. 355/20 to include additional lands; permit additional residential dwelling types on the subject lands; and clarify parking standards on the subject lands.
O. Reg. 355/20, as amended, permits a range of residential uses (i.e. single detached dwellings, townhouse dwellings, apartment buildings, etc.), institutional uses, and parks and recreational trails on lands located at the north east corner of Highway 35 and Colborne Street, legally described as Part Lot 22 Concession 4 in the City of Kawartha Lakes. For illustrative purposes, the subject lands are shown in a location map, the link to which is set out below.
Pursuant to subsection 47(4) of the Planning Act and except for the purposes of section 24, the Minister deemed O. Reg. 355/20, as amended to be and to always have been a by-law passed by the Council of the City of Kawartha Lakes.
