Decision details

A decision was made on November 4, 2022, to approve, with 77 modifications, Amendment No. 167 to the Hamilton Urban Official Plan and to approve, with 25 modifications, Amendment No. 34 to the Hamilton Rural Official Plan, as adopted by By-law Nos. 22-145 and 22-146 respectively. Notice of the decision was provided to the City on November 4, 2022.

The adopted official plan amendments were reviewed for consistency with the Provincial Policy Statement and conformity with provincial plans and policies, and to ensure that the amendments have regard for matters of provincial interests as outlined in the Planning Act.

Modifications to the policies and mapping of the official plan amendments have been made to implement an urban boundary expansion, and modify policies related to growth management, infrastructure, employment, land use compatibility and natural hazards, as well as secondary plans and site-specific matters.

The Hamilton Urban and Rural Official Plan Amendments, as approved, outline a land use policy framework to guide growth and development in the City to the year 2051, including policies and schedules related to housing, planning for employment and infrastructure, and public health and safety, among other matters. These amendments comprise Phase 1 of the City's municipal comprehensive review.

Pursuant to subsections 17(36.5) and (38.1) of the Planning Act, the decision of the Minister of Municipal Affairs and Housing regarding an official plan adopted in accordance with section 26 is final and not subject to appeal. Accordingly, the Hamilton Urban Official Plan Amendment and Hamilton Rural Official Plan Amendment, as approved with modifications by the Minister, came into effect on November 4, 2022.

The official plan amendments apply to all lands within the City of Hamilton.

Effects of consultation

A total of 80 comments were received through the ERO, and an additional 24 comments were received through direct submission during the 30-day period. The vast majority of comments received were with respect to Hamilton’s urban boundary, including support for a firm urban boundary, and support for an urban boundary expansion with a varying quantum and location. Other comments received addressed policy matters, including land use compatibility, densities and building heights, as well as site-specific land use designations.

The modifications implement an urban boundary expansion, and address matters such as land use compatibility, densities, building heights, and site-specific matters, including employment area conversions. 

All comments reviewed were taken into consideration prior to a decision being made.

On June 8, 2022, the City of Hamilton adopted amendments to the Urban Hamilton Official Plan and Rural Hamilton Official Plan pursuant to sections 17 and 26 of the Planning Act by By-law Nos. 22-145 and 22-146. The amendments are now before the Minister of Municipal Affairs and Housing for a decision under the Planning Act.

The amendments to the Urban Hamilton Official Plan and Rural Hamilton Official Plan propose that the City will accommodate population and employment growth to 2051 within the City’s existing urban area, as well as a five hectare urban expansion to Waterdown Village. The amendments provide policy direction on growth management, urban structure, housing, employment, cultural heritage, climate, and infrastructure, among other matters.

If approved, the amendments to the Urban Hamilton Official Plan and the Rural Hamilton Official Plan would apply to the entirety of lands within the City of Hamilton.
