A decision was made on November 4, 2022 to approve, with modifications, the Region of York Official Plan, as adopted by By-Law 2022-40. Notice of the Decision was provided to the Region of York on November 4, 2022.
The adopted official plan was reviewed for consistency with the Provincial Policy Statement, 2020, applicable provincial plans and regard for matters of provincial interest outlined in the Planning Act.
The eighty (80) modifications to the official plan have been made by the Minister to address provincial policy direction and government priorities related to growth management, future urban areas, transportation, transit, infrastructure, land use compatibility, agricultural uses, hazards and the protection of drinking water. Changes were also made to the mapping of the official plan to add additional Urban Areas in the Township of King, City of Markham and Town of Whitchurch-Stouffville. Employment Areas in the City of Vaughan was also converted for non-employment uses.
Please note, proposed settlement area expansions into the Oak Ridges Moraine Conservation Plan in the Town of Whitchurch-Stouffville, that were originally adopted by the Region of York, were deleted from the Official Plan.
The Region of York Official Plan, as modified and approved, outlines a comprehensive land use policy framework to guide growth and development within the Region to the year 2051, including policies and schedules related to density and intensification; phasing of development and infrastructure; major transit station areas; housing; planning for employment; environmental and agricultural protection; and public health and safety, among other matters.
Pursuant to subsections 17(36.5) and (38.1) of the Planning Act , the decision of the Minister of Municipal Affairs and Housing regarding an official plan adopted in accordance with section 26 is final and not subject to appeal. Accordingly, the new Region of York Official Plan, as modified and approved by the Minister, came into effect on November 4, 2022.
The new official plan applies to all lands within the Region of York.
Effects of consultation
Public consultation on the adopted Official Plan was undertaken over 30 days, from September 8, 2022 to October 8, 2022.
As a result of public consultation, the Ministry received a total of 34 comments through the Environmental Registry of Ontario and 23 comments by email or mail.
The comments came from a wide variety of stakeholders and individuals.
Several submissions from individuals and environmental organizations expressed concerns regarding the proposed settlement area expansions into the Oak Ridges Moraine Conservation Plan area. Modifications to the Official Plan have deleted the proposed expansion areas.
Comments related to adding additional Urban Area, converting Employment Areas, adding site-specific development policies, development phasing and servicing, and identifying new or revised major transit station areas were also received. Modifications were made to the Official Plan to address these requests, including settlement area expansions in the Township of King, City of Markham and Whitchurch-Stouffville, an Employment Area conversion in City of Vaughan, and the expansion of two major transit station areas.
Comments related to land use compatibility were also received. A number of modifications were made to the Official Plan to ensure sensitive land uses and major facilities are appropriately located and planned for, and consideration for the impacts of advancing urban areas on agricultural operations.
Other comments received were deemed out-of-scope, were not consistent with the PPS or did not conform with the applicable provincial plans.
All comments were carefully considered and analyzed as part of the Minister’s decision.

Original proposal
Proposal details
On June 30, 2022, York Region adopted a new Official Plan pursuant to Sections 17 and 26 of the Planning Act by By-law 2022-40. The York Official Plan is now before the Minister of Municipal Affairs and Housing for a decision under the Planning Act.
The Regional Official Plan proposes policies on long-term growth management, settlement areas, housing, employment areas, natural heritage and agricultural systems, among other matters.
If approved, the Official Plan will apply to all lands within the Region including the Town of Aurora, Town of East Gwillimbury, Town of Georgina, Township of King, City of Markham, Town of Newmarket, City of Richmond Hill, City of Vaughan, and Town of Whitchurch-Stouffville.
