Bulletin summary

On March 24, 2023, the Minister of Municipal Affairs and Housing filed an amendment to the Zoning Order O. Reg. 771/21, made pursuant to clause 47(8) of the Planning Act, with the Registrar of Regulations as O. Reg. 54/23.

Why consultation isn't required

Part II of the Environmental Bill of Rights Act, 1993 does not apply to proposals to make a Minister's Zoning Order (MZO) under subsection 47(1) of the Planning Act, or to amend or revoke an MZO under subsection 47(8) of the Planning Act.

Bulletin details

A Zoning Order Amendment, made pursuant to clause 47(8) of the Planning Act, regulates the use of land and the erection, location and use of any building or structure on the land.

O. Reg. 771/21, as amended by O. Reg. 163/22 and O. Reg.. 490/22, permits residential uses, commercial uses, institutional uses, trail system and new parks for a new neighbourhood development immediately east of the community of Lindsay in the City of Kawartha Lakes.

The amendment to the Zoning Order O. Reg. 771/21, filed as O. Reg. 54/23, adds approximately 202 hectares to the Zoning Order, as well as amends the text of the Zoning Order to permit additional commercial uses and to make technical changes to the zoning requirements. The lands subject to the Zoning Order, as amended are approximately 450 hectares in size and are legally described as Part of Lots 18, 19, 20, 21, 22, and 23, Concession 7, and Part of Lots 18, 19, and 20, Concession 8 in the City of Kawartha Lakes. For illustrative purposes, the subject lands are shown in a location map, the link to which is set out below.

Pursuant to subsection 47(4) of the Planning Act and except for the purposes of section 24, the Minister deemed O. Reg. 771/21, as amended, to be and to always have been a by-law passed by the Council of the City of Kawartha Lakes.
