Bill 139, Less Red Tape, More Common Sense Act received Royal Assent on December 4, 2023

Bulletin summary

The Minister of Red Tape Reduction has introduced Bill 139 (Less Red Tape, More Common Sense Act, 2023) to the Ontario legislature, to move forward on initiatives that will improve services for people, reduce costs for businesses, and make it easier to work with government.

Why consultation isn't required

The Less Red Tape, More Common Sense Act, 2023 is a package of legislative changes led by the Minister of Red Tape Reduction.

The amendments within the bill are from ten (10) ministries that are responsible for evaluating their individual legislative proposals and amendments against the public consultation requirements of the EBR. Where there is potential for an environmental impact, the responsible ministry has completed a proposal notice to which it has been posted on the environmental registry.

There are proposals in this Bill that do not have significant impact on the environment but may impact businesses. Opportunities to comment on these additional proposals are available on Ontario’s Regulatory Registry.

 

Bulletin details

The Ministry of Red Tape Reduction has proposed an Act to modernize and update legislation to improve services for people, reduce costs for businesses, and make it easier to work with government. The proposed amendments in this Act are reflective of modern technology, and current best practices. This Bill includes 20 Acts that will be affected:

  2. Algoma University Act, 2008
  3. Charities Accounting Act
  4. Commodity Futures Act
  5. Corporations Act
  6. Credit Unions and Caisses Populaires Act, 2020
  7. Farm Registration and Farm Organizations Funding Act, 1993
  8. Financial Services Regulatory Authority of Ontario Act, 2016
  9. Modernizing Ontario for People and Businesses Act, 2020
  10. Motor Vehicle Dealers Act, 2002
  11. Niagara Escarpment Planning and Development Act
  12. Nipissing University Act, 1992
  13. Ontario College of Art & Design University Act, 2002
  14. Ontario Heritage Act
  15. Professional Engineers Act
  16. Retirement Homes Act, 2010
  17. Securities Act
  18. St. Lawrence Parks Commission Act
  19. Université de l’Ontario français Act, 2017
  20. University of Ontario Institute of Technology Act, 2002

Out of the 20 individual Acts, two (2) ministries have determined amendments to their individual legislations may result in environmental impact and have posted proposal notices on the Environmental Registry. Summary of Proposed Notices:

Ministry: Ministry of Citizenship and Multiculturalism

Act:  Ontario Heritage Act, O.Reg. 385/21 General

Title of notice: Proposed changes to the Ontario Heritage Act and O.Reg. 385/21 General with respect to certain alteration requests.

Summary of amendment(s):

A proposal to make legislative and regulatory amendments to the Ontario Heritage Act (OHA) and O.Reg. 385/21 (General) that, if passed and approved, would allow religious groups and Indigenous communities to move forward with their proposed alterations more quickly in situations where the requirements of the provision are met.

Ministry: Ministry of Natural Resources and Forestry

Act: Niagara Escarpment Planning and Development Act

Title of notice: Proposed Amendments to the Niagara Escarpment Planning and Development Act

Summary of amendment(s): The Ministry of Natural Resources and Forestry is proposing amendments to the Niagara Escarpment Planning and Development Act to:

  • Remove the outdated requirement to publish notices in newspapers for NEP amendment proposals and associated hearings
  • Expand the Minister’s regulation-making powers to allow broader exemptions for low-risk activities where standard conditions would provide appropriate mitigation in regulation
  • Broaden the range of compliance tools and powers to provide NEC staff greater abilities to inspect and address non-compliant development activities.

By reducing delays and focusing on more complex applications and protection measures, the Ministry would be creating more efficient processes and saving time for applicants, while ensuring protection for the escarpment is maintained.
