The Ministry of Mines (the "Ministry") has reviewed the feedback gathered on “Seeking input on opportunities to improve Ontario’s mineral exploration assessment work regime”.  A summary of the feedback received has been outlined herein. 

Decision details

The Ministry consulted on “Seeking input on opportunities to improve Ontario’s mineral exploration assessment work regime” for 45 days from October 19 to December 3, 2023.

The intent of this public engagement was to gather feedback on initiatives to make improvements to the assessment work regime in order to reduce duplication, clarify rules and build the geoscience database of Ontario.

These initiatives were categorized under three broad themes:

  • Maximizing Ontario’s Competitiveness and Work Conducted on Mining Claims;
  • Increasing Access to and Expanding the Availability of Public Geoscience Data; and
  • Minimizing Unnecessary Administrative and Reporting Processes for the Submission of Assessment Work Reports.

Interested parties were also encouraged to include thoughts on any other proposals related to improving the assessment work regime not contemplated in the proposal materials.

The Ministry appreciates all the feedback received during this public engagement period.

Effects of consultation

The comments received from the public, Indigenous communities and organizations, non-profits and industry were considered and have informed decisions regarding various proposed changes.

Summary of comments and ministry responses

 

Responses were supportive of proposals that would increase the quality and availability of geoscience data gathered through assessment work, such as allowing the submission of raw and processed data sets. These comments have informed the Ministry’s decision to proceed with a new follow-up proposal to pursue specific changes to the assessment work reporting requirements. The Ministry will consider the responses received in developing any potential changes to the legislative, regulatory, Technical Standards and/or policy for reporting assessment work in Ontario.

 

There were also a variety of additional opportunities suggested to reduce administrative and reporting burdens within the Mining Lands Administration System (MLAS).

 

Responses were also supportive of proposals that clarified the guidelines and reduced duplication or unnecessary paperwork.

 

Respondents supported changes to a variety of reporting processes including:

 

  • changes to the requirement of providing all receipts and invoices for every expense;
    • The Ministry will be proposing a new process which would not require receipts to be submitted, and instead allow for random audits.
  • introducing a service standard for the Ministry’s response time once a proponent responds to a notice of determination, and;
  • the introduction of voluntary templates to assist in the reporting process.

 

 

There was concern about removing the grass roots prospecting double credit incentive; however, there was support for streamlined eligibility requirements. The Ministry will be seeking feedback on a proposal to maintain the incentive, but clarify the eligibility criteria to help ensure it is achieving its goal of encouraging new, early-stage prospecting and exploration.

 

Respondents also supported expanding eligibility for assessment work credit, and the Ministry will be seeking feedback on requiring raw and processed data where applicable for certain work types and allowing mobilization/demobilization costs from other provincial jurisdictions.

 

While there was some support for changing the current credits in reserve process the Ministry has decided not to proceed at this time. There were a number of conflicting comments on the increase to annual work requirement and related change to Daily Rate/Sweat Equity, so the Ministry has decided to consider the comments further.

 

The Ministry also heard mixed support or some concerns about a number of proposals which it has decided not to proceed with at this time, including moving work types out of regulation and into administrative policy, Ministry intervention in boundary claim resolution and allowing costs related to artificial intelligence as an eligible expense.

 

Ministry Response:

The Ministry appreciates the feedback received during this public engagement period. These comments have informed the Ministry’s decision to proceed with a new follow-up proposal to pursue specific changes to the assessment work reporting requirements.

In Ontario, pursuant to the Mining Act, prospectors looking to undertake early exploration work can register a mining claim on lands where mining rights are open for claim registration. A mining claim grants the holder of the claim the exclusive right to explore for minerals, after obtaining the necessary permitting, approvals and any required consultation, on a designated piece of land. In order for claim holders to keep their claims in good standing and maintain their right to explore for minerals, the Ministry of Mines (“Ministry”) requires that claim holders actively explore the lands for minerals to at least some extent. This is called “assessment work”.

Holders of unpatented mining claims must provide a report to the Ministry summarizing the assessment work that has been undertaken or, subject to certain limitations, make payments in place of completing the assessment work, on a periodic basis. Assessment work reports that are submitted to the Ministry are made available to the public and add to the overall geoscience knowledge of Ontario.

Ontario is committed to being a leading jurisdiction in mineral exploration and development to increase our global competitiveness. The Ministry invites you to provide feedback on overarching objectives for improving Ontario’s early exploration assessment work regime, and potential initiatives outlined below and in the supporting attachment to this notice. The Ministry is also seeking to solicit important feedback you may have outside of these initiatives and encourages you to submit a written response explaining how other proposals could improve the exploration sector in Ontario

  • To maximize Ontario’s competitiveness and work conducted on mining claims, the Ministry is seeking feedback on potential changes to:
     
    • Annual Work Requirement;
    • Grass Roots Prospecting Double Credit Incentive;
    • Daily Rate/Sweat Equity; and 
    • Credits in Reserve
       
  • To increase access to, and expand the availability of public geoscience data, the Ministry is seeking feedback on potential changes to:
     
    • Work types, geoscience data, and related expenses eligible for assessment work credits.
       
  • To minimize unnecessary administrative and reporting processes for the submittal of assessment work reports, the Ministry is seeking feedback on potential changes to:
     
    • Proof of work/expense verification;
    • Service standards and reporting processes;
    • Submittable templates for assessment work and guidelines;
    • Mining Lands Administration System (MLAS) improvements;
    • Maximize lands available for mineral exploration and resolution of issues related to boundary claims; and
    • General amendments including moving work types out of regulation and into policy, and removing work types that are underutilized.

The attached document, Improving Ontario’s Assessment Work Regime, provides further details on the Ministry’s proposal and includes several questions to which you may respond. The Ministry will consider the information and responses received as it continues to develop options to improve Ontario’s assessment work regime.

The Ministry currently anticipates that the environmental implications of this proposal should be neutral.

Anticipated results

Consulting on the assessment work regime will assist the Ministry in developing an updated framework that would support Ontario’s efforts to increase the competitiveness of the mineral sector and support strong supply chains. It is expected that adding to the geoscience database would enhance the understanding and attractiveness of Ontario’s mineral potential.
