Decision summary
The Minister of Municipal Affairs and Housing has decided to amend a Minister's Zoning Order in the City of Pickering, filed as Ontario Regulation 607/20.
Decision details
The Minister of Municipal Affairs and Housing (the Minister) consulted on proposals to potentially revoke, amend, or enhance monitoring of specific zoning orders where limited progress has been made towards implementation of the proposed development.
The zoning orders that were identified for consultation are those where the proposed development had made limited progress on either advancing subsequent planning and development approvals or in addressing water and wastewater servicing on the lands subject to the zoning order in a reasonable timeframe to realize the project.
Ontario Regulation (O. Reg.) 607/20 was proposed to be amended based on limited progress being made on the subsequent approvals needed for project implementation on portions of the subject lands. Based on the information received, further progress has not been demonstrated.
With the filing of O. Reg 164/24, O. Reg 607/20 has been amended and the portion of the site removed from O. Reg. 607/20 is now fully subject to the in effect applicable municipal zoning by-laws.
Effects of consultation
The consultation was open for 45 days to provide an opportunity for municipalities, project proponents, stakeholders, and the public to provide feedback and comments. In addition, municipalities, along with project proponents and Indigenous communities, were notified separately by letter. Notification emails were sent to various groups (i.e. municipalities, industry organizations, Indigenous communities) with a link to the ERO posting.
Responses provided the ministry with information about implementation progress on this site. This information was reviewed against the original criteria for assessing whether limited progress has been made towards the implementation of the proposed development, and on that basis the Minister decided to proceed with amending this zoning order.

Original proposal
Proposal details
Take notice that the Minister of Municipal Affairs and Housing, under subsection 47(8) of the Planning Act, is consulting on a proposal to amend a Minister's Zoning Order in the City of Pickering, Regional Municipality of Durham, filed as Ontario Regulation 607/20.
Ontario Regulation 607/20 applies to the lands identified in Reference Map No. 265 as amended (see attached below). The lands subject to the Zoning Order were approximately 92 hectares (227 acres) in size, and located at 1802 and 1902 Bayley Street and 2028 Kellino Street.
Ontario Regulation 607/20 as amended by Ontario Regulation 515/21, removed the land and zoning permissions for the property located at 1802 Bayly Street.
The Minister is proposing to amend Ontario Regulation 607/20 to remove approximately 2.3 hectares (5.7 acres) of land from the Zoning Order. For illustrative purposes, the lands subject to the proposed amendment are shown in the notice map below.
A Zoning Order regulates the use of land and the erection, location and use of structures on the land. Ontario Regulation 607/20 provides direction on the land uses and associated development standards permitted within the Subject Lands.
