Approval is granted to amend the existing Environmental Compliance Approval No. A592001 issued for the use and operation of a waste disposal site located in Red Rock, Ontario.
The facility was previously associated with a former forest products facility and the approval is updated to reflect current conditions and landfilling requirements associated with general site clean-up activities. The service area is limited to onsite rehabilitation activities by Red Rock Mill Development Inc.
The site is consist of a 19.5 hectares of landfilling area within a total area of 45.6 hectares for the disposal of solid non-hazardous waste limited to sewage sludge from on-site sewage works (lagoons) and residual solid waste (wood residual, demolition debris including debris from general site activities including maintenance, decommissioning and rehabilitation) generated on the entire Red Rock Mill property covering an area of about 135.93 hectares. The site total approved capacity is 1,626,855 cubic metres. The hours of operation are seven days per week, 24 hours per day. Reclamation of lime/lime mud may also occur at the site. The proponent is required to submit a financial assurance in the amount of $6,469,889.00 to the director.
Effects of consultation
There was no comment received from the public in response to ERO posting. However, seven responses were received in response to Neighbour Notification sent to the neighboring properties. A summary of comments received via Neighbour Notification and our response is provided below:
- do not support the amendment approval because of environmental effects of such amendment
- instead of landfilling, consideration should be given to recycling
- raised questions about source of waste, why the site is to be operation 24/7, who is to go to pay for attendant, source of lime mud and social issues
- Nipigon Bay is the last area of concern and no remedial action ever taken place
- dust issues if lime pile is to be moved
- there is no site activity and what is the on-site source of waste
- is potential for spills into Lake Superior, potential for leaching into Lake, who is responsible for funding in case of waste removal
- require access to the complete set of documents/report
Response:
The site is an approved waste disposal site since 1976, and the proponent is required by the local ministry office to update the site operational plan including assessment of in-pace waste, remaining capacity and seek approval of the site waste disposal operations per the current regulatory framework. At this time, the ministry only considered modernizing and updating the site approval to ensure it is consistent with the current regulatory framework. No additional waste disposal is permitted or considered other than the waste to be generated from the site decommissioning operations. The site owner is responsible for the site maintenance, closure and post-closure maintenance including environmental monitoring.
In addition, the approval requires the owner to provide financial assurance (FA) to the ministry, funds sufficient to implement the site closure and post-closure activities in case the owner fails to meet its obligations. The FA was not part of the original approval. As part of the amendment, a groundwater and surface water monitoring program is proposed and which is being included in the approval including submission of an annual report during operations of the site and after site closure.

What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?

The service area is limited to onsite rehabilitation activities by Red Rock Mill Development Inc. The site will consist of a 44.27-hectares fill area within a total area of 135.93 hectares for the landfilling of the following waste categories:
- wood residuals
- lime/lime mud
- wastewater treatment plant biosolids
- general non-hazardous solid waste
The site will have a final volumetric capacity of 1,626,855 cubic metres. The hours of operation are seven days per week, 24 hours per day. Reclamation of lime/lime mud may also occur at the site.
