On February 18, 2026, the Minister of Municipal Affairs and Housing made a Minister's Zoning Order in the Township of Elizabethtown-Kitley as Zoning Order 004-2026.
Decision details
A Zoning Order, made pursuant to clause 47(1)(a) of the Planning Act, regulates the use of the land and the erection, location and use of any building or structure on the land. The Minister’s Zoning Order (MZO) was requested by the Township of Elizabethtown-Kitley and supported by the Mayor of the Township of Elizabethtown-Kitley.
Zoning Order 004-2026 applies to approximately 9.5 hectares of land located at 3826 County Road 6 in the Township of Elizabethtown-Kitley. The subject lands are known as the former Township of Elizabethtown-Kitley fairground (Rows Corners) and are located approximately 800 metres north of the City of Brockville. The land to the west of the subject lands contains a solar farm while the lands to the north and east of the site are vacant and contain woodland.
Zoning Order 004-2026 facilitates the redevelopment of the former Township fairgrounds to include fourteen 3-storey residential buildings permitting a total of 320-560 dwelling units, one commercial building, parkland, and communal amenity space.
The MZO also establishes zoning requirements including types of permitted commercial uses, minimum setbacks, maximum building heights, minimum parking spaces and minimum amenity area requirements.
Pursuant to subsection 47(1.0.1) of the Planning Act, the Minister has imposed a condition on Zoning Order 004-2026 with respect to the site being serviced by municipal water and wastewater services. The condition was requested by the Township of Elizabethtown-Kitley. As a result, Zoning Order 004-2026 is suspended until the Minister of Municipal Affairs and Housing is satisfied this condition has been, or will be, fulfilled.
Pursuant to the subsection 47(4) of the Planning Act, the Minister deemed this Zoning Order to be a by-law passed by the Council of the Township of Elizabethtown-Kitley.
This Zoning Order made pursuant to clause 47(1)(a) of the Planning Act was posted for consultation as a regulation. Bill 60, Fighting Delays, Building Faster Act, 2025 received Royal Assent on November 27, 2025, and therefore this Order is not a regulation and will not be filed with the Registrar of Regulations. The Order came into effect upon signing by the Minister of Municipal Affairs and Housing.

Why consultation isn't required
Part II of the Environmental Bill of Rights Act, 1993 does not apply to proposals to make a Minister’s Zoning Order (MZO) under subsection 47(1) of the Planning Act, or to amend or revoke an MZO under subsection 47(8) of the Planning Act.
Although not required, the ministry is providing public notice of this request for consultation.
Proposal details
As part of the Cutting Red Tape to Build More Homes Act, 2024, the government is proposing to amend the Planning Act to remove the Minister’s authority to make Community Infrastructure and Housing Accelerator orders. However, a Minister’s Zoning Order, made pursuant to clause 47(1)(a) of the Planning Act, can still be used to regulate the use of the land and the erection, location and use of any building or structure on the land.
The Ministry has also introduced a zoning order framework that will help guide – in a transparent manner – how zoning order requests are considered in support of provincial priorities. Moving forward, municipal requests for zoning orders will be received and considered in accordance with the new zoning order framework.
The Ministry is in receipt of a request for a Community Infrastructure and Housing Accelerator order to facilitate a residential development in the Township of Elizabethtown-Kitley. This municipal request applies to 12 hectares of land located at 3823 County Road 6 in the Township of Elizabethtown-Kitley.
While no Community Infrastructure and Housing Accelerator orders will be made going forward, the Minister may instead consider making a Minister’s Zoning Order in response to this request, provided there is municipal support and other information outlined in the zoning order framework is provided.
