Why consultation isn't required
Part II of the Environmental Bill of Rights Act, 1993 does not apply to proposal to amend or revoke a Minister's Zoning Order under subsection 47(8) of the Planning Act.
Bulletin details
The lands subject to this amendment are municipally known as 0 Highway 7 in the City of Pickering and located at the south-east former of Highway 7 and Sixth Concession Road. The lands are legally described as Part of Lot 12, Concession 6.
The subject lands are identified within the Minister's Zoning Order, filed as Ontario Regulation 102/72, which was enacted in 1972 to protect lands for the future Pickering Airport. The Zoning Order generally only permits low impact land uses including agricultural uses, and accessory buildings, and structures that will be used to support the primary agricultural operations.
The effect of the amendment is to permit a single-detached dwelling. The purpose of the amendment is to allow for a residential use that is not associated with an agricultural operation.

Section 47(8) of the Planning Act allows the Minister of Municipal Affairs and Housing to amend or revoke a Minister’s Zoning Order.
