Decision summary
On December 20, 2024, the Minister of Municipal Affairs and Housing filed a Minister's Zoning Order with the Registrar of Regulations as Ontario Regulation (O. Reg.) 561/24 in the City of Toronto. The City of Toronto requested that the Minister consider making the Zoning Order.
Decision details
A Zoning Order, made pursuant to clause 47(1)(a) of the Planning Act, regulates the use of the land and the erection, location and use of any buildings or structure on the land. The Minister's Zoning Order was made based on a request from the City of Toronto.
O. Reg. 561/24 facilitates a new purpose-built mosque and a community centre, along with a new mid-rise residential building that will include a minimum of 220 purpose-built rental units.
O. Reg. 561/24 applies to approximately 1.2 hectares of lands at 65 Rexdale Blvd in the City of Toronto. See Location Map below.
Pursuant to the subsection 47(4) of the Planning Act, and except for the purposes of section 24, the Minister deemed this zoning order to be a by-law passed by the council of the City of Toronto.
Effects of consultation
All comments received were taken into consideration prior to a decision being made.
Of the 43 submissions, 36 were from members of the public raising concerns about the demolition of the existing mosque, the location for residential use, the level of community consultation for the proposed development, and general health and safety concerns with the well-being of the community.
Other submissions received were from: the Greater Toronto Airports Authority (GTAA) who requested to review the submission to assess noise and height impacts to the nearby Toronto Pearson Airport; NAV Canada have indicated no objection at this time but require that project details continue to be shared with them throughout the development process; Toronto Industry Network (TIN) raised concerns with the proposed development in relation to land-use compatibility, the amount of information and studies, loss of employment areas, and requested to be included in discussions; XTL Transport Inc. raised concerns about the current employment area and anticipated vehicle traffic negatively impacting their operations; and Save IMO Toronto raised concerns with the community consultation for the proposed development, the organization's internal financial decision-making, and included a petition of members of Save IMO Toronto opposed to the Minister’s Zoning Order.

Why consultation isn't required
Part II of the Environmental Bill of Rights Act, 1993 does not apply to proposals to make a Minister’s Zoning Order (MZO) under subsection 47(1) of the Planning Act, or to amend or revoke an MZO under subsection 47(8) of the Planning Act.
Although not required, the Ministry is providing public notice of this request for consultation.
Proposal details
The Ministry of Municipal Affairs and Housing is consulting on a municipal-endorsed request for a Minister’s Zoning Order.
A Minister’s Zoning Order, made pursuant to clause 47(1)(a) of the Planning Act, regulates the use of land and the erection, location and use of any building or structure on the land.
The Ministry is in receipt of a request for a Minister’s Zoning Order to facilitate the conversion of an area of employment to a mixed-use residential development at 65 Rexdale Boulevard in the City of Toronto.
The Subject Lands are approximately 1.2 hectares and are located at the southwest corner of the intersection of Rexdale Boulevard and Vetiver Drive. The Subject Lands contain a 2-storey building and a surface parking lot and are currently occupied by the International Muslim Organization of Toronto.
If made, the requested Minister’s Zoning Order would permit:
- a purpose-built mosque and community centre
- a 9-storey mid-rise residential building, including a minimum of 220 purpose-built rental units.
To help ensure decisions are made in a transparent manner and support government priorities, the Ministry is seeking feedback on whether this request should be considered and any additional information that may help inform a decision.
