Bulletin summary

The Director has issued an amendment to an order under the Environmental Protection Act for the purpose of requiring delineation of Perchloroethylene (PCE)-related contamination that may be present at the site and discharging from the site, located at 180 Wortley Road, London.

Why consultation isn't required

These changes were not significant enough to warrant a new proposal notice. The changes do not vary the work required by the Order but set out requirements to carry out priority assessment work on a specified timeline.

Bulletin details

On May 23, 2024, Director’s Order No. 1-218350098-A1 was issued under sections 18, 196 and 197 of the Environmental Protection Act, to the owner and operator of the site located at 180 Wortley Road in London, Ontario, and the companies’ current directors and officers. The purpose of this Director’s Order is to require:

  • delineation of Perchloroethylene (PCE)-related contamination that may be present at the site and discharging from the site;
  • assessment of soil vapor intrusion risk into off-site buildings due to the presence of PCE-related contamination; and,
  • registration of a certificate of requirement on title.

On August 23, 2024, the following amendments were made to the Director’s Order:

  • Under PART A - Work Ordered:
    • Item No. 12 was added to require the Orderees to prepare an Assessment Plan to undertake assessment work to sample, monitor, and record the presence of contaminants discharged from the site.
    • Item No. 13 was added to require the Orderees to submit the completed Assessment Plan to the Director.
    • Item No. 14 was added to require the Orderees to implement the Assessment Plan, which is to take into account any written comments on the plan provided by the Director.
    • Item No. 14 was added to require the Orderees to provide a written report summarizing the results of work completed in accordance with the Assessment Plan.
  • Under PART B – Definitions:
    • ‘2024 Technical Support Memorandums’, ‘Gandhi Memo’, ‘GHD Report’, and ‘Harris Memo’ were defined.
    • a duplicate definition for “Director” was revoked.
    • the defined term for “Qualified Person” was revoked and replaced.
  • A copy of the Amending Director’s Order No. 1-218350098-A1 is provided under supporting materials.
